The Court of Appeal has granted the application by lawyers for former NAFCO CEO Hanan Abdul-Wahab Aludiba seeking to halt the trial pending the determination of an appeal against a High Court ruling.
The High Court in July dismissed Hanan's application to drop the charges against him, citing a defective charge sheet. The court held that the charge sheet contained reasonable information for the defence. It however, ordered the prosecution to amend the charges which the defence had raised issues with.
Lawyers of the former NAFCO CEO, led by Godfred Yeboah Dame challenged the ruling and filed an application to stay the proceedings pending the determination of the appeal.
Deputy Attorney-General Dr Justice Srem-Sai leading the state, opposed the application to stay the trial arguing that there was no exceptional circumstances in the request.
A three-member panel of justices of the Court of Appeal on Monday ruled that exceptional circumstances have been established for the grant of the prayer to halt the trial at the High Court.
Justice Noble Nkrumah presiding over the case indicated that the charge sheet contained the fundamental issues which the prosecution would rely on in its trial against Hanan Aludiba and his wife hence any contention surrounding it ought to be resolved before proceeding.
The grant of the defence's prayer means the case at the High Court will be on hold as the appellate court determines the substantive appeal against the High Court's ruling.
