Malaysia’s government is about to become a meaningful Bitcoin holder, and it didn’t have to buy a single coin to get there.
The Kuala Lumpur High Court has ruled that the state will retain approximately 321.64 Bitcoin seized in connection with the Bitkingdom investment scam. At current prices, that stash is valued at about $26.2 million.
The coins trace back to a scheme that ran between 2015 and 2016.
How the coins got split
Authorities seized a total of 497.82 BTC tied to Bitkingdom. The court then had to decide who gets what.
Nine victims came forward in the proceedings. Collectively, they had deposited 362.04 Bitcoin into the scheme.
The court ordered roughly 176.18 BTC returned to those nine claimants. That covers a bit less than half of what they originally put in.
The reason for the haircut is simple arithmetic. Total claimed losses from the scam exceeded the amount authorities actually recovered, so victims could only receive a proportional share.
Everything left over, the approximately 321.64 BTC, stays with the government. Add the two figures together and you land exactly on the 497.82 BTC originally seized.
The partial restitution ruling came on October 12, 2026. It followed an earlier decision on December 23, 2025, in which the court classified the seized assets as proceeds of unlawful activity under the Malaysian Penal Code.
A pitch that aged badly
Bitkingdom’s offer was the kind that should set off alarms. The scheme promised investors daily returns of about 1%.
The fallout was substantial. Police reports linked to the scheme indicated losses close to 1,023 BTC, spread across 207 individuals.
That figure matters for understanding the court’s math. Authorities recovered under half of what victims reported losing, which is why restitution became a game of dividing a smaller pie.
Victims in the case successfully showed that fraudulent claims had led to their financial losses. That evidentiary work was what allowed the nine claimants to recover anything at all.
The scheme collected deposits back when Bitcoin was trading below $1,000. With Bitcoin currently assessed at around $81,400 per coin, the dollar stakes of this case have grown dramatically while it worked its way through the system.
The awkward question of who keeps the rest
The most striking detail is the gap between what victims reported losing and what they got back. Only nine of the people represented in those 207 police reports ended up with a court-ordered share in this ruling.
Meanwhile, the state keeps a larger pile than it handed out. The government’s retained portion is nearly double the amount returned to victims.
Under the court’s framework, funds not claimed and proven by victims ended up forfeited to the government.
What this means
For crypto investors, the case offers a sobering lesson about timelines. Fraud that happened in 2015 and 2016 only reached a restitution ruling in 2026, and even then, successful claimants recovered less than half their deposits in Bitcoin terms.
For victims elsewhere, the proportional formula used here is the key detail. When recovered assets fall short of total losses, the people who prove their claims split what is available, and the shortfall is permanent.
There is also a timing wrinkle in valuing recoveries. Victims who lost Bitcoin get Bitcoin back, which means their partial recovery is now worth far more in dollar terms than their original deposits were at the time of the scheme, when Bitcoin traded below $1,000.
