A family arrives in Miami from Colombia, rents a car at the airport, and begins exploring South Florida. Two days later, another vehicle hits their rental car at an intersection. Suddenly, their vacation involves hospital appointments, insurance paperwork, and questions about who will pay the medical bills.
A Miami car accident creates additional challenges for international visitors unfamiliar with Florida’s insurance system. Rental agreements, rideshare coverage, and medical payment rules operate differently from those in many Latin American countries.
Understanding these differences is essential when an unexpected collision interrupts a visit to the United States.
Rental Car Insurance Has Specific Rules
Tourists renting vehicles in Miami often purchase insurance without fully understanding what the agreement covers. Rental companies offer different protection options, and coverage depends on the contract and underlying insurance policies.
Under Florida Statutes Section 627.7263, qualifying rental company liability and personal injury protection insurance is generally primary unless the rental agreement contains specific language assigning that responsibility to the renter’s coverage.
The statute requires this alternative arrangement to appear in at least 10-point type on the rental agreement.
Confusion over which policy pays first is one reason international visitors seek help for a car accident in Miami even when another driver appears responsible.
Travelers need to examine their rental contract and insurance documents rather than assuming the protection purchased at the counter covers every expense.
Uber and Lyft provide convenient transportation between Miami International Airport and popular destinations. However, accidents involving these services introduce additional insurance considerations.
Under Florida Statutes Section 627.748, transportation network companies must maintain specified insurance coverage while drivers use their platforms.
When a driver accepts a passenger request, the law requires at least $1 million in primary automobile liability coverage during the prearranged ride.
The insurance requirements differ when a driver is logged into the application without an accepted ride.
Understanding the circumstances surrounding injuries to rideshare passengers helps explain why trip records become important after a collision.
Section 627.748 also requires companies to retain individual ride records for at least one year.
Florida’s 14-Day Medical Treatment Requirement
Medical treatment creates another financial concern for visitors injured far from home.
Florida operates a no-fault automobile insurance system, but personal injury protection (PIP) benefits are not automatically available to every international tourist. Eligibility depends on the vehicle, insurance arrangements, and the injured person’s circumstances.
Under Florida Statutes Section 627.736, qualifying individuals must receive initial medical services within 14 days after the accident to access PIP medical benefits.
The statute generally provides reimbursement for 80% of qualifying medical expenses, subject to coverage limitations. The maximum medical and disability benefit is $10,000, with medical benefits limited to $2,500 without a qualifying emergency medical condition determination.
These restrictions make prompt medical evaluation particularly important when travelers plan to return home shortly after an accident.
Police Reports Have Their Own Timeline
Accident documentation remains important even when visitors leave Florida before their insurance claims are resolved.
Under Florida Statutes Section 316.066, investigating officers must submit a long-form crash report within 10 days after completing an investigation involving specified circumstances, including personal injuries.
The statute also protects identifying information in crash reports from general public disclosure for 60 days after filing. Involved parties and their authorized representatives have access under statutory exceptions.
International visitors benefit from retaining the investigating agency’s information before leaving the country.
Digital Insurance Claims Require Accurate Records
Insurance companies increasingly use online systems to receive accident photographs and supporting documents.
Developments in digital insurance claims have introduced automated document processing and image analysis into the industry.
However, electronic submissions still depend on accurate information.
Visitors returning to Latin America need copies of their medical records and insurance correspondence. Original photographs and rental agreements also provide evidence when questions arise after departure.
A digital claim submission does not replace the legal filing requirements governing a personal injury lawsuit.
Florida’s Two-Year Legal Deadline
Florida establishes a separate timeline for pursuing negligence claims.
Under Florida Statutes Section 95.11(5)(a), negligence lawsuits generally have a two-year statute of limitations, subject to statutory exceptions.
This deadline applies independently of ongoing insurance negotiations. Returning to Colombia, Mexico, or another country does not automatically extend the filing period.
For international visitors, the consequences are significant. A pending insurance claim does not preserve the right to file a Florida negligence lawsuit after the statutory deadline expires.
