A British software engineer wants 324.8 BTC back from Bitmex, claiming the cryptocurrency exchange had no legal authority to offer him derivatives trading in the United Kingdom. His demand, worth approximately $26 million using today’s exchange rates, targets more than 1,000 losing trades.
Key Takeaways
- Lewis Barber seeks 324.8 BTC from Bitmex over 1,053 losing derivatives trades between 2018 and 2022.
- Barber’s claim alleges Bitmex offered regulated derivatives in Britain without the required FCA authorization.
- Bitmex says HDR Global Trading Limited has not been formally served with Barber’s lawsuit.
British Trader Challenges Four Years of Bitcoin Losses
Lewis Barber, a software engineer from Chelford, Cheshire, has reportedly filed a High Court claim in London against HDR Global Trading Limited, the Seychelles-incorporated company behind Bitmex. The Guardian and The Mirror reported on the proceedings, which challenge the legality of derivatives transactions conducted between 2018 and 2022.
The reports say that Barber wasn’t exactly a casual customer. Across five accounts, he allegedly executed approximately 2,294 trades, but his legal challenge focuses exclusively on 1,053 transactions that lost money. Every disputed position involved perpetual swaps, derivatives contracts that allow traders to speculate on cryptocurrency prices without an expiration date.
Bitmex pioneered perpetual swaps in cryptocurrency trading, introducing the now-ubiquitous derivatives contracts that would become one of the industry’s most heavily traded financial instruments. The reports detail that the requested restitution amounts to 324.8 BTC, valued at approximately $26.5 million on Oct. 14, 2026. Barber is seeking the original bitcoin in-kind or equivalent damages and interest.
An FCA Warning Returns to Haunt Bitmex
The legal argument centers on Britain’s Financial Services and Markets Act 2000 (FSMA). Barber contends that Bitmex conducted regulated financial activities without authorization from the Financial Conduct Authority (FCA), potentially rendering the disputed contracts unenforceable against him.
His lawyers also allege deceit, negligent misrepresentation, and mistake, arguing that Bitmex represented itself as legally entitled to conduct the transactions. The allegations have historical ammunition. On March 3, 2020, the FCA warned that Bitmex was operating without authorization and targeting British consumers.
The claim also references international advertising campaigns, including a January 2019 advertisement in The Times. Barber’s legal representatives at Seladore Legal formally sought to rescind the transactions in December 2025.
Gareth Keillor, a partner at the firm, suggested the implications might extend beyond his client, observing that other British traders potentially entered comparable contracts. Whether those customers have recoverable claims would depend on their individual circumstances.
Bitmex Disputes Service as Wider Implications Loom
There’s an important procedural wrinkle. Although the lawsuit has been filed, it had not been formally served. “No such claim has been served on HDR Global Trading Limited,” a Bitmex spokesperson stated to Daniel Boffey, chief reporter for The Guardian. The dispute arrives after Bitmex ceased trading operations on Sept. 23, 2026, following a strategic review and orderly wind-down. Withdrawals remained available.
Founded in 2014 by crypto entrepenuers Arthur Hayes, Ben Delo, and Samuel Reed, Bitmex helped popularize perpetual swaps before encountering regulatory difficulties in the United States. Barber’s allegations remain untested, and no hearing date has been announced. Yet the central question is consequential. If the court accepts his interpretation of British financial law, losing trades executed years ago could become the subject of restitution claims rather than simply the cost of speculation.
