The Information reports that PayPal and Epic Games are among the developers concerned that a potential antitrust settlement between Apple and the DOJ might not go far enough in addressing the company’s allegedly anticompetitive practices. Here are the details.
A bit of context
A few months ago, Bloomberg reported that Apple and the DOJ were in talks to settle a 2024 antitrust lawsuit alleging that the company illegally monopolized the US smartphone market at the expense of consumers, developers, and competitors.
When the DOJ first filed the lawsuit, Apple pledged to “vigorously” defend itself and has continued to push back against the government’s allegations ever since.
Despite Bloomberg’s report about settlement talks, the case has continued to move forward, with Apple and the DOJ recently clashing over access to internal documents from federal agencies during discovery.
However, as The Information reported today, settlement talks have also continued behind the scenes, with the Justice Department apparently prioritizing iPhone interoperability.
Settlement talks advance
According to the report, the “department appears to be focusing on a deal addressing interoperability issues developers face with the iPhone,” although developers are concerned that any resulting settlement might impose only limited restrictions on Apple’s practices.
From the report:
As part of its talks with developers, the Justice Department has asked them for a list of ways to improve the iPhone’s ability to operate with other devices, the people said.
Many developers and antitrust lawyers are concerned that the Justice Department will offer Apple a settlement that imposes relatively light requirements on how its devices interact with other companies’ devices.”
According to The Information, PayPal and Epic Games are among the developers that have directly raised concerns about a potential settlement with DOJ officials.
Meanwhile, some people involved in the settlement negotiations reportedly expected a resolution much sooner, although the pending Senate confirmation of Adam Candeub, Trump’s nominee to lead the DOJ’s antitrust division, could be contributing to the delay.
The report adds that Apple has changed some of its products and policies since the DOJ brought the lawsuit in 2024, including improving messaging interoperability with Android devices, but is likely to resist more substantial changes to its ecosystem, potentially complicating efforts to reach a settlement.
Asked about the discussions, a DOJ spokesperson declined to comment on the specifics, saying only that the department would “continue to prioritize affordability for all Americans across our economy.” Other companies mentioned in the report, including PayPal and Epic Games, declined to comment, while Apple didn’t respond.
