Guatemala top judge Jenny Alvarado Tení took office on Tuesday 13 October as head of the Supreme Court and the judiciary. She swore an oath before Congress and then received the insignia of office from her predecessor at a ceremony in Guatemala City.
The handover matters beyond Guatemala because her court will sit through the run-up to the 2027 general election. It will also handle immunity and constitutional appeals that can decide which politicians face trial, and when.
How the Handover Happened
Congress president Luis Contreras Colíndres administered the oath on Tuesday, under a legislative decree approved on 6 October. The state news agency AGN said the procedure follows Article 165 of the constitution, which lists the powers of Congress.
The transfer of command took place that evening in the Gran Sala Efraín Recinos of the Centro Cultural Miguel Ángel Asturias. President Bernardo Arévalo, the centre-left reformer elected in 2023, attended the ceremony, according to AGN.
Outgoing president Claudia Paredes handed over the insignia, which formally completed the change at the top of the judiciary. Paredes had been elected in February and served only about eight months, Prensa Libre reported.
The 13 magistrates chose Alvarado Tení unanimously on Wednesday 30 September. AGN said it was the first time in eight years that the court elected its president within the ordinary legal timetable.
Who Is the New Guatemala Top Judge
Alvarado Tení is a lawyer and notary with postgraduate studies and a doctorate in criminal law and criminal procedure. Before joining the Supreme Court she sat for nine years on the Sixth Criminal Appeals Chamber in Cobán, Alta Verapaz.
Congress elected her to the current court, which serves from 2024 to 2029, with 104 votes in October 2024. Prensa Libre describes her as the fifth woman to lead Guatemala’s judiciary.
The court also named the heads of its three chambers on 30 September. Igmaín Galicia Pimentel leads the amparo and immunity chamber, René Girón the criminal chamber and Claudia Paredes the civil chamber.
In her first speech she promised rulings grounded in law, transparent procedures and concrete results. She said judicial independence means judges decide without pressure, while still coordinating respectfully with the other branches.
The Doubts She Inherits
The judiciary she takes over has faced allegations of sold court jobs, discretionary appointments and lost firearms in recent years. Watchdog groups Movimiento ProJusticia and Alianza por las Reformas told Prensa Libre that restoring credibility is her main task.
Those groups also link her to a lawyers’ faction led by former constitutional magistrate Nester Vásquez and to several members of Congress. They argue such ties could weigh on cases that reach the court during the 2027 campaign.
Alvarado Tení told Prensa Libre she knows those figures only professionally and that the ties would not influence her rulings. She added that judges can recuse themselves when their impartiality is in doubt.
Before the vote, La Hora reported that her support rested on an informal deal over judicial appointments, a claim not independently confirmed. On Tuesday she told reporters that court jobs are not sold and urged anyone with evidence to file a complaint.
Election Year and Budget
The full court has already approved a plan to strengthen the amparo and immunity chamber for the 2027 vote, including extra staff. She said the chamber expects a heavy load of legal challenges once the electoral process begins.
The judiciary has asked Congress for about Q6.5 billion (about US$851 million) for 2027, a figure she called approximate. Conversions use the Banco de Guatemala reference rate of Q7.63988 per US dollar on 14 October.
She wants more courts and appeals chambers, renewed computers and a push toward electronic case files to cut the backlog. She is also promoting reforms to the criminal procedure code on victims’ rights and human trafficking.
Spending is already under scrutiny, since La Hora found the judiciary awarded Q167,266 (about US$21,900) for snacks and drinks at the ceremony. The contract went to Valores Hoteleros SA, according to public procurement records cited by the paper.
What It Means for You
For US readers, Guatemala’s courts hear the extradition requests and the drug and corruption cases tied to the United States. Attorney General Gabriel García Luna said on Wednesday he will travel to Texas and twice to Washington to review joint cases.
For companies and investors, the promise of digital files and shorter deadlines would ease commercial and labour disputes if it is delivered. The risk is that an election-year caseload slows the system again.
For travellers and residents, nothing changes in daily life, since the handover was orderly and on schedule. Background: Guatemala Explained 2026: The Country, Its Politics, Its Economy and What to Watch and Who Is Bernardo Arévalo, Guatemala’s President in 2026.
What Is Not Known
It is not known how Congress will treat the judiciary’s 2027 budget request, or how many new courts it would fund. The exact size of the electoral reinforcement for the amparo chamber has not been published.
It is also unclear whether the Guatemala top judge will step aside from cases involving the lawmakers that watchdogs name. Background: Guatemala’s New Attorney General Turns on His Predecessor’s Network and the Guatemala City page.
