Meta has been hit with a record $25 billion penalty over Facebook’s handling of user data. Yet Wall Street appears remarkably calm. The company’s shares are rising, with investors focused on its booming AI business and a major earnings report due tonight.
A New Mexico judge ordered Meta to pay $25 billion on Wednesday, October 21, after a jury found that Facebook repeatedly misled consumers about privacy protections and its handling of personal information.
The ruling is the largest financial penalty imposed on Meta to date.
Yet Meta stock climbed roughly 2% to around $708 in afternoon trading. The company, worth approximately $1.8 trillion, showed little immediate sign of investor panic.
There are reasons Wall Street might be looking beyond the penalty. Meta faces a lengthy legal battle, while its newly launched Muse AI assistant is attracting millions of users.
How Did Facebook End Up With a $25 Billion Penalty?
The case goes back to the Cambridge Analytica scandal, which erupted in 2018.
The British political consulting firm obtained information from as many as 87 million Facebook users through a third-party personality quiz app. The data was used for political profiling, including work connected to Donald Trump’s 2016 presidential campaign.
New Mexico sued Meta in 2021, accusing Facebook of misleading residents about how their information was protected. The allegations also covered the company’s claims about tackling misinformation and enforcing content moderation policies.
A jury reached its verdict on September 25, finding nearly 44 million violations of New Mexico’s consumer protection laws.
Under state law, those violations could have justified more than $219 billion in penalties. Judge Francis Mathew reduced the amount to $25 billion.
The money is intended for New Mexico’s public education system.
Why Is Meta Stock Rising Despite the Fine?
The jury’s September verdict meant investors already knew Meta faced a potentially enormous financial penalty. Wednesday’s ruling provided a clearer figure, while leaving room for an appeal.
D.A. Davidson technology analyst Gil Luria told Reuters that the ongoing legal process means the cases are “unlikely to cause a material impact to Meta’s value.”
At approximately $1.8 trillion in market capitalization, the $25 billion penalty represents around 1.4% of Meta’s market value.
The broader technology sector also rallied Wednesday, with the Nasdaq gaining approximately 1.2%. Meta’s share-price increase therefore cannot be attributed solely to the court ruling.
Meanwhile, the company’s AI business has given investors another reason for optimism.
Meta’s Muse AI assistant, launched on September 8, has reached 10.9 million downloads. Its daily active users reached 2.5 million on October 16.
Meta stock has gained roughly 15% since Muse launched, although its shares have pulled back from their October highs.
The numbers suggest strong early demand.
However, Meta has also devoted substantial advertising spending to promoting Muse. Its ability to turn that popularity into sustainable profits remains unproven.
What Should Meta Investors Watch Next?
The more immediate test for Meta stock comes after Wednesday’s closing bell, when the company releases its third-quarter earnings.
Analysts expect approximately $63.3 billion in revenue, representing around 24% annual growth.
Meta has also projected $130 billion to $145 billion in capital expenditure for 2026, largely to support AI infrastructure and its core business.
Investors will want to see whether advertising revenue can continue supporting that spending, and whether Muse can eventually generate enough income to justify its growing operating costs.
Options traders were pricing in a potential 6.3% move in Meta shares by the end of the week surrounding its earnings announcement.
That makes tonight’s results a potentially bigger short-term catalyst than Wednesday’s legal ruling.
Still, the privacy judgment adds another liability at a time when Meta is committing unprecedented sums to AI. Its long-term stock performance will depend heavily on whether those investments produce meaningful returns.
When Will Meta Actually Pay the $25 Billion?
Meta is expected to appeal the ruling, arguing that the penalty is excessive and that the state failed to establish actual consumer harm.
An appeal could take years. Meta may also seek a court-approved stay to delay enforcement while the case proceeds. The amount could ultimately be reduced, overturned or resolved through a settlement.
However, delaying payment carries a cost. Source New Mexico reports that the judgment carries 15% annual interest while unpaid.
If the full penalty survives, that interest could substantially increase Meta’s financial exposure.
For now, investors appear more concerned with Meta’s earnings and AI ambitions. Whether that optimism lasts will depend on how its business performs and how much of the $25 billion judgment eventually becomes payable.
