Analysis
The OCC's application and reporting forms reached OMB on Oct 23. That does not open the door, but it finally puts a comment deadline, a sixty-day decision clock and a Dec 22 outer edge on a wait that had none of them.
The Office of the Comptroller of the Currency moved its stablecoin licensing regime forward on October 23, 2026, by submitting information collection requests to the Office of Management and Budget. Two Federal Register notices, FR Doc 2026-21704 and FR Doc 2026-21705, carry the same admission: the agency is “giving notice that it has sent the collection to OMB for review” while seeking a new control number, 1557-NEW, for its licensing applications and its reporting requirements. Filed October 22 and published the next day, they are the first dated acts in a paperwork sequence that has so far had no dates at all.
What did not happen is the part the market will go looking for. The application window for prospective issuers stays closed: no control number assigned, no approval granted, no OCC press release announcing that it is ready to accept filings. The agency is not yet accepting applications.
The review now has dates on the record. The comment period for both notices closes on November 23, 2026, the notices’ own thirty-day window and the minimum the Paperwork Reduction Act requires before a decision. After that, the statute gives the OMB Director sixty days from the later of receipt or publication to notify the OCC of approval or denial. Measured from October 23, that runs to December 22, 2026. If no notice arrives in time, the same provision lets approval be inferred, requires a control number without further delay, and lets the collection run for up to a year. Silence has a clock now; it just has no calendar entry.
What the OMB is deciding is narrower than what the market is waiting on. The OCC cannot collect the information without an approved control number, and by its own Bulletin 2026-51 that same approval is the switch for the door: “The OCC will begin accepting applications upon receiving final approval from the Office of Management and Budget (OMB) of the information collection related to the application forms,” with the start announced in a press release. The review is about burden and justification, not about who may issue a stablecoin.
It has already moved the OCC’s own arithmetic. The revised reporting notice raises the assumed number of permitted payment stablecoin issuers from thirty to forty, and puts the combined annual burden of weekly Form PS-01 and quarterly Form PS-02 at 10,458 hours, against 6,308 hours in June. The application collection is modeled on forty respondents and 4,915 hours. A regulator’s respondent count is a bet on how many entrants show up, and this one just moved by a third.
Downstream, the clocks are finally priceable. If and when the OCC begins accepting applications, the sequence it has published runs like this: notice within thirty days on whether an application is substantially complete, an answer to supplemental material within thirty days, a return no later than sixty days after the first notice, and a final decision within 120 days of a substantially complete determination. The waiver lane for the prior-approval requirement is anchored to January 18, 2027, the day compliance kicks in with criminal penalties attached. Reporting follows the same clock: first weekly report due January 27, 2027, first quarterly report by April 30, 2027.
This does not replace the two pieces we ran this week, it arms them. The Dateless Window Tax measured what the wait costs new entrants, and the rulebook piece read what the final rule settled and left open. What this adds is the machinery’s own dates: a comment close, a statutory decision window, an outer edge, and the specific act that would end the wait.
For Q1 2027 roadmaps, the read is bounded uncertainty rather than a date. Hold readiness against December 22 as the outer edge of the statutory clock, not as an opening, and keep it through the January 18 compliance date, because the trigger on the record is OMB approval plus a press release, not the calendar. Anything that depends on being early has to be filed-ready before either number matters.
Limits, plainly. December 22 rests on reading October 23 as the later of receipt or publication, which is how the notices line up. The OMB can act sooner, ask for changes, or run past the point where the inferred-approval path applies, and that path is a statutory backstop rather than a forecast. No approval date, no control number and no press release exist on the record today, and this piece does not predict when they arrive.
