The trial of a 46-year-old man accused of defiling a 10-year-old girl in Chisamba has been adjourned to October 26, 2026, to allow the state to bring additional witnesses.
Chisamba Resident Magistrate Susan Magalashi adjourned the matter after three prosecution witnesses testified in court.
Roy Chilala of Mweemba Village in Chief Liteta’s area has pleaded not guilty to one count of defilement, contrary to Section 138(1) of the Penal Code, Chapter 87 of the Laws of Zambia, as amended by Acts Number 15 of 2005 and Number 2 of 2011.
It is alleged that on October 3, 2026, Chilala had unlawful carnal knowledge of a girl under the age of 16.
Among the witnesses who testified was a 13-year-old boy who told the court that he was herding cattle with two friends when a man identified as Mazuba asked him to check an abandoned house where he had seen the accused enter with the girl.
The boy told the court that he looked through a window and saw Chilala with his trousers lowered to his knees, allegedly having sexual intercourse with the girl, who was lying on her back.
“After I peeped through the window, I saw Roy making love to a girl whilst his pair of trousers were below the knees and a girl was facing upwards while her siblings were outside the house,” the boy narrated.
He told the court that when he returned with Mazuba to check on the situation, the alleged act had ended, but the accused was still inside the abandoned house while the girl was outside collecting firewood.
The court further heard that the girl later reported the alleged abuse to her grandmother, who reported the matter to Chisamba Police Station, leading to the accused’s arrest.
Meanwhile, Chilala remains in detention as the matter awaits continuation of trial on October 26, 2026.
