Mali’s transitional parliament has widened the state’s power to strip nationality from its own citizens. The ordinance now reaches Malians by birth, and the vote was unanimous among the 119 members present.
Mali’s transitional parliament ratified on Thursday, 22 October 2026 an ordinance extending nationality loss to Malians by birth. All 119 members present voted in favour, says a communiqué of the Conseil national de Transition (CNT) relayed by Koaci.
Until now the measure, known in French as déchéance de nationalité, applied almost only to naturalised citizens. The ordinance extends it to Malians of origin, meaning people who hold Malian nationality by birth.
What the Nationality Loss Ordinance Changes
The text amends the Code des personnes et de la famille, which rests on Law No. 2011-087 of 30 December 2011. The authorities judged that framework insufficient against what they call hostile acts by some nationals.
The grounds named in the coverage include formal allegiance to another state and collaboration with hostile, secessionist or terrorist organisations. Participation in acts of terrorism is also listed as a ground.
The EU SEE alert of Wednesday, 29 July 2026 summarised the July draft in more detail. It adds financing and glorification of terrorism, plus use of former public office to harm Mali’s interests.
It also lists civil society leaders who cooperate with entities classed as hostile, and exiles who join a terrorist or separatist group. These grounds come from the draft, not from the unread ratified text.
Madar, citing the Agence de presse africaine (APA), reports that deprivation cannot be pronounced if it would leave the person stateless. The EU SEE alert words this point in a garbled way, so the safeguard in the final text is unconfirmed.
How the Ordinance Reached the Parliament
The Council of Ministers, chaired by General Assimi Goïta, adopted the draft on Friday, 17 July 2026. Justice Minister Mamoudou Kassogué presented it as a response to the shortcomings of the current system.
Koaci, Madar and La Nouvelle Tribune give 13 August 2026 as the date of the ordinance itself. Madar, citing APA, adds that the text has applied since its adoption and that ratification prevents it from lapsing.
That ratification step was the CNT vote of Thursday, 22 October, at the Centre international de conférences de Bamako. The plenary session was chaired by CNT president Malick Diaw.
Legal Limits and International Law
The UN Treaty Collection lists Mali as acceding to the 1961 Convention on the Reduction of Statelessness on 27 May 2016. The convention bars deprivation of nationality on racial, ethnic, religious or political grounds.
The coverage reviewed does not say which interests of Mali would justify a revocation, what proof is required or who decides. It also does not describe any appeal route.
Niger offers a comparison, with 25 people provisionally stripped of nationality under a 2024 order, Human Rights Watch said on 22 September. The group says Niger’s process lacks meaningful legal safeguards.
The EU SEE alert calls the draft a worrying development for civil liberties and civic space. It notes that in July the text still needed promulgation by the head of state and ratification by the legislature.
What It Means for US Readers
If the reported statelessness bar holds, only Malians with another nationality could lose theirs, possibly including people living in the United States. No source names any specific person as a target.
Human Rights Watch said on Tuesday, 17 March 2026 that the United States had lifted sanctions on three senior Malian officials. They included Defense Minister Sadio Camara, sanctioned in 2023 over links to the Wagner Group.
Human Rights Watch said Washington appears to be seeking closer security cooperation with Sahel governments, including Mali. None of the coverage reviewed links the ordinance to a US person, company or sanction.
What Is Not Known
Neither the ratified text, the CNT communiqué nor the APA report cited by Madar could be opened. The grounds above come from outlets that summarise the text and from the July draft.
The sources differ on dates, with the draft adopted on 17 July and the ordinance dated 13 August. Promulgation, entry into force and the statelessness bar in the final text are unconfirmed.
No individual has been named as a target, and no revocation has been reported in the coverage reviewed. The procedure, the standard of proof and the appeal route are not described.
Reactions from the Malian opposition, the diaspora and the United Nations were not found in the coverage reviewed. The number of Malians who hold a second nationality is also unknown.
