KUALA LUMPUR: Malaysia Border Control and Protection Agency director-general Datuk Seri Mohd Shuhaily Mohd Zain will face two charges of voluntarily causing hurt to two Special Branch policemen at the Sepang magistrate's court tomorrow.
Attorney-General Tan Sri Mohd Dusuki Mokhtar confirmed the matter, saying the charges would be framed under Section 323 of the Penal Code.
"I confirm that Datuk Seri Shuhaily will be charged at the Sepang magistrate's court tomorrow morning with two counts of voluntarily causing hurt to two rank-and-file policemen," he said.
The provision carries a maximum jail term of one year, a fine of up to RM2,000, or both upon conviction.
Lance Corporals Mohammad Faiz Muhamad Saman, 40, and Muhammad Ekmal Sofwan Driman, both Travel Control Officers, alleged that Shuhaily physically assaulted them at Kuala Lumpur International Airport Terminal 1 on Sept 28.
Their lawyers, Kamal Hisham Ja'afar and Muhammad Nor Tamrin, claimed the alleged assault took place in a public area, causing injuries and affecting their clients' dignity as civil servants carrying out their duties.
They denied that their clients were acting as touts or involved in "counter setting".
Meanwhile, Shuhaily said he had been informed of the proceedings and would attend court, adding that he was ready to face any outcome under the country's legal system.
