Mexico’s federal prosecutors have taken into custody the former attorney general of Chihuahua, accusing him of acts that could amount to treason over the role of foreign agents in a state anti-drug raid. César Jáuregui Moreno led the state prosecutor’s office until he resigned on 27 April, and he has not been convicted of anything.
The case matters to US readers because the foreigners at its centre were two US citizens killed in a road accident after the raid. Mexican media, including Infobae México, report that they were CIA agents, while the federal prosecutor’s public statement speaks of foreigners and two US citizens.
What Federal Prosecutors Allege
Attorney General Ernestina Godoy said on the night of Saturday, 17 October, that a federal judge had issued an arrest warrant for acts that may constitute treason in the area of national security. She said the decision rested on more than 100 investigative steps, from desk work to fieldwork.
According to Godoy, Jáuregui ordered and coordinated the April operation at El Pinal and allowed foreigners to take part without authorisation in work reserved for federal forces. She said Chihuahua had no power to take such actions and that the state did not alert federal authorities in time.
Godoy said the two Americans repeatedly entered the state investigation agency’s offices without a justified reason. She said the conduct threatens the nation’s sovereignty and integrity and is expressly forbidden by the Constitution, and she said the National Security Law limits what states may do in areas reserved to the federal government.
The April Operation and the Crash
The raid took place between 17 and 19 April against clandestine drug laboratories at El Pinal, in the mountain municipality of Morelos. After the operation, a road accident killed four people: two members of the state investigation agency and two US citizens.
Jáuregui, then attorney general, first presented the foreigners as instructors from the US embassy. Days later it emerged that both were CIA agents, according to Infobae México, and he resigned on 27 April.
Two Arrests in Two Days
State officers detained Jáuregui on the morning of Saturday, 17 October, on a state case for illegal exercise of public service and for a so-called coalition of public servants. The federal warrant could not be executed at once because he was already in state custody.
On Sunday, 18 October, state judge Luis Alberto Simental Ortega declined to order pretrial detention on the state case. He imposed conditions including surrender of his passport and US visa, a ban on leaving Chihuahua or Mexico, and monthly court appearances.
Federal agents then executed the warrant, and Jáuregui’s lawyer, Héctor Villasana, said he would be moved to the Altiplano federal prison in the State of Mexico. The state judge extended the deadline to decide whether the state case goes forward and set the hearing to resume on Thursday, 22 October, at 10:00 a.m., while Villasana said a federal hearing could take place on Tuesday, 20 October.
What It Means for US Readers
The case tests the limits of US-Mexico security cooperation, which Washington relies on in its fight against fentanyl. The federal prosecutors’ argument is that working with foreign agents outside federal channels is illegal, even when the target is a drug laboratory.
US readers should watch whether the US government comments on the two Americans who died and what the case file shows. The accusations are unproven in court, and Jáuregui is presumed innocent.

What Is Not Known
The federal case file is not public, so the evidence behind the treason theory cannot be checked. It is also not known how a federal judge will rule on the charge.
The role of the two Americans is reported by Mexican officials and media but has not been shown in public documents. Whether any US agency will comment on the case is not known.
