Dagazau: Legislative oversight must not become a tool for personal grudges

The constitutional responsibility of the National Assembly to exercise oversight over public institutions is fundamental to accountability, transparency and good governance. However, that responsibility must be exercised with restraint, fairness and strict adherence to due process, particularly when petitions contain allegations capable of damaging the reputation of individuals.

It is against this background that the recent disclosure by the Chairman of the House of Representatives Committee on Petroleum Resources (Downstream), Hon. Ikenga Ugochinyere Imo, concerning a petition alleging money laundering and abuse of office against the Executive Vice President, Downstream, of the Nigerian National Petroleum Company Limited (NNPCL), Dr. Mumuni Dagazau, has generated concerns.

The central question is not whether the House of Representatives has the authority to receive and investigate petitions. It does. Rather, the concern is whether announcing allegations against an individual at a public event before an investigation has established their credibility serves the interests of justice, parliamentary accountability and responsible public communication.

Critics of the committee chairman’s approach have questioned the timing and manner of the disclosure, arguing that making allegations public before establishing their substance risks creating an impression that a conclusion has already been reached.

They have also questioned why the petition was singled out for public attention and whether similar petitions received by the relevant committee over the past four years have been treated in the same manner.

These questions deserve answers, particularly because parliamentary oversight must be guided by consistency, impartiality and the public interest rather than by personalities or political considerations.

Sections 88 and 89 of the 1999 Constitution, as amended, provide the National Assembly with powers to investigate matters within its legislative competence and to summon persons, receive evidence and obtain information in the course of its proceedings.

These powers are essential to ensuring that public institutions discharge their responsibilities effectively and that public resources are properly managed.

However, the existence of investigative powers does not remove the obligation to act fairly. A petition is an allegation requiring examination, not proof of wrongdoing. Its submission does not automatically establish a prima facie case, much less determine the guilt of the person named in it.

Consequently, when allegations of serious misconduct are announced publicly before the subject has been given an opportunity to respond, the process risks becoming a trial by the media.

The concern is particularly significant where the allegations involve money laundering and abuse of office, offences that carry serious reputational and legal implications.

The mere fact that a petition has been received should not be interpreted as confirmation of the allegations it contains.

Why this petition, and why now?

Another question arising from the controversy concerns the decision to announce the petition during the House Committee Downstream Week, a gathering expected to provide an opportunity for substantive discussions about the challenges and prospects of Nigeria’s petroleum downstream sector.

Was the petition selected for public disclosure because it had reached a stage requiring an official announcement, or were there other considerations behind the decision?

How many petitions has the committee received during the past four years, and how many have been publicly announced before preliminary investigations were concluded?

These are legitimate questions of institutional accountability. Providing clear answers would help demonstrate whether the committee’s approach is consistent with established procedures or represents a departure from its normal practice.

Hon. Ugochinyere’s critics have alleged that the public disclosure could be connected to a personal grievance. However, such a claim remains an allegation and should not be treated as an established motive without supporting evidence.

Nevertheless, the chairman has a responsibility to ensure that the committee’s actions do not create a reasonable perception that its investigative powers are being deployed selectively or used to settle personal scores.

Public confidence in legislative oversight depends not only on the authority of committees but also on the transparency, consistency and fairness with which that authority is exercised.

Dagazau’s experience in the energy industry

Dr. Dagazau is not a newcomer to Nigeria’s energy industry. His professional background spans more than 35 years in the private sector, with experience in operational management, strategy development, business transformation and corporate leadership. 

He has held positions in organisations including M.R.S Oil and Gas Limited, A.A. Rano and OVH Energy Limited, building experience across the oil and gas industry and related business sectors.

According to his professional profile, his core competencies include strategy execution, supply chain management, business development, risk management and the development of solutions to complex operational challenges.

In terms of achievements at NNPCL, Dagazau advanced refinery portfolio reviews, valuation  processes, and technical partnership engagements aimed at repositioning refinery assets for long-term sustainability and competitiveness.

He also expanded crude trading activities and strengthened shipping partnerships to optimise commercial performance across the downstream value-chain 

He was also instrumental in enhancing value delivery through expanded LNG trading operations, CNG penetration and broader downstream market participation as well as expanded the Oleum lubricant brand across the West African sub-region to strengthen regional market presence.

These credentials do not place any public officer beyond scrutiny. Rather, they provide context for assessing the professional responsibilities and experience of an executive who occupies a senior position in one of Nigeria’s most strategically important sectors.

Any allegations against him should be examined on their merits, with the same standards of evidence, fairness and accountability that ought to apply to every other public officer.

Equally, his professional standing should neither be used to prejudge the petition nor ignored in any discussion of his career and contributions to the industry.

Protecting the integrity of NNPCL and parliament

The transformation of the Nigerian National Petroleum Corporation into Nigerian National Petroleum Company Limited under the Petroleum Industry Act was intended to establish a commercially oriented national oil company operating within a reformed petroleum industry.

The effectiveness of that framework depends on corporate accountability, financial discipline, transparency and compliance with applicable laws.

No institution or executive should be shielded from legitimate investigation. Equally, no officer should be presumed guilty simply because a petition has been submitted against them.

Where credible evidence of wrongdoing exists, the appropriate authorities should investigate and take necessary action in accordance with the law. Where allegations cannot be substantiated, the process should equally protect the individual concerned from unjustified reputational damage.

This balance is essential to credible governance.

The leadership of the House of Representatives therefore has an interest in ensuring that committees conduct their activities in ways that protect the integrity of Parliament and maintain public confidence in its investigative processes.

A clear distinction must be maintained between receiving a petition, determining whether it warrants investigation, examining the evidence and reaching any eventual conclusion.

These are separate stages, each requiring appropriate care and procedural fairness.

Dr. Dagazau retains the right to respond to allegations against him and to pursue any remedies available under the law if he believes his reputation has been unlawfully damaged.

At the same time, the committee must be allowed to discharge its legitimate responsibilities without interference, provided those responsibilities are exercised within the law and in accordance with established procedures.

The way forward is not to replace one unverified allegation with another, but to insist on transparency, evidence and fair treatment.

Hon. Ugochinyere should clarify the circumstances surrounding the disclosure, while the committee should explain the status of the petition and the process through which it intends to examine the allegations.

Such clarification would help address concerns about selectivity, establish whether the committee followed its usual procedures and reassure the public that the matter is being handled objectively.

The National Assembly must remain a forum for accountability and the public interest. Its authority is strongest when it is exercised impartially, supported by evidence and insulated from personal vendettas.

Until the petition against Dr. Dagazau has been properly examined, the allegations should remain allegations, not a verdict on his character or professional record.
