AI tools could flag inconsistencies between H-1B visa holders’ residential addresses and employer-reported worksite details.
US immigration authorities could increasingly use artificial intelligence (AI) tools to identify inconsistencies across immigration filings, putting the spotlight on the accuracy of records maintained by H-1B visa holders and their employers.A release issued by Womble Bond Dickinson, a law firm, warns that AI-assisted checks could help identify discrepancies between an employee’s reported residential address and the worksite information submitted by an employer in an H-1B petition. One scenario highlighted by the firm involves an employer filing an amendment to an H-1B petition to reflect a change in worksite location after the employee has already submitted an AR-11 change-of-address notification to US Citizenship and Immigration Services (USCIS).The reverse situation could also attract attention: an employee moves but fails to submit the required AR-11 notification, leaving the government’s records potentially inconsistent with the employee’s actual circumstances. The firm identifies these as examples of discrepancies that AI tools may detect when comparing information across filings. Why consistency mattersThe issue is particularly relevant to H-1B professionals working remotely or moving homes while continuing in the same job.
An address change and a change in the authorised place of employment are distinct matters, but information relating to both may be available in immigration records.Form AR-11 is used to report a change of address to USCIS. Separately, an employer may need to file an amended H-1B petition when a material change in employment conditions, including certain changes in worksite location, requires it under applicable rules.Consequently, employees and employers should not assume that updating one record automatically satisfies the requirements relating to the other. For instance, an employee who relocates to a different area while working remotely may need the employer to assess whether the new location falls outside the area covered by the existing labour condition application (LCA). Depending on the circumstances, an amended petition and a new LCA may be necessary.AI could connect records across applicationsThe broader concern is that immigration applications may no longer be assessed solely as individual submissions. AI-assisted analysis could help officials compare information across earlier and current filings, potentially bringing discrepancies to light that might otherwise be difficult to identify manually. For Indian professionals, who constitute a significant chunk of H-1B visa holders, this makes consistency across address notifications, employment details and previous immigration applications particularly important.
Differences in dates, job locations or other particulars may require clarification, even where they arise from administrative oversights rather than deliberate misrepresentation. However, the identification of a discrepancy does not, by itself, establish fraud or a violation of immigration law. The circumstances and supporting documentation would remain important in determining its significance. What employers and employees should doEmployers sponsoring H-1B workers should review their procedures for recording residential moves, changes in worksite locations and amendments to employment petitions.
Employees, meanwhile, should notify their employers promptly of relevant changes and ensure that required address notifications are submitted.A review of earlier filings may also help identify discrepancies that need to be addressed or explained before a future extension, amendment or other immigration application is submitted. The central message from Womble Bond Dickinson is that, as AI-assisted analysis develops, maintaining accurate and consistent immigration records is becoming increasingly important for both employers and foreign professionals.
