Four of seven electoral court ministers voted to overturn André Mendonça’s order to delete a Lula campaign video. He then moved the case to an in-person session, leaving the ruling open.
Justice André Mendonça halted the electoral court vote on a Lula video on Thursday, 15 October, after four ministers voted against him. The 4 to 3 majority would have let the Lula campaign video stay online, ten days before the 25 October runoff.
Mendonça asked for a destaque, a request that moves a case from the court’s online session to an in-person session. Agenda do Poder, Em Dia ES and BPMoney said he filed it after all seven ministers had voted.
A 13 October order by Mendonça covered Lula’s posts on X and on Instagram, which US group Meta owns. Orders of this kind reach US platforms ten days before a runoff that US investors follow closely.
What the Lula Video Said
President Luiz Inácio Lula da Silva of the Workers’ Party (PT) seeks re-election in the runoff on Sunday, 25 October. His rival Flávio Bolsonaro, a conservative senator and eldest son of former president Jair Bolsonaro, runs for the Liberal Party (PL).
Flávio’s campaign asked the court to remove a Lula video linking his “tesouraço” spending-cut pledge to cuts in social programmes. The 15 October reports name Farmácia Popular, a subsidised pharmacy scheme, and Minha Casa, Minha Vida, a housing programme.
Gazeta do Povo, Metrópoles and Brasil 247 said Mendonça ordered a Lula “tesouraço” video deleted on Tuesday, 13 October. The order gave three hours and a fine of 10,000 reais (about US$1,980) per day or per new post.
Why Mendonça Ordered the Video Deleted
In the 13 October order, Gazeta do Povo and Metrópoles said, Mendonça found the video presented cuts to social programmes as certain. He wrote that it lacked minimal factual basis and called it a “generalised threat” to the continuity of social policies.
He found that Flávio’s plan defines the “tesouraço” as cutting ministries, appointed posts, running costs, perks and top salaries. The plan, filed with the TSE, does not propose ending those programmes, though he said opponents may question its proposals.
How the Court Voted 4 to 3
The TSE has seven ministers: three Supreme Court justices, two Superior Court of Justice judges and two lawyers. In its online plenary, four voted to overturn Mendonça’s order, Poder360, Agenda do Poder and Em Dia ES said.
- Against the order (4): Estela Aranha, who opened the dissent, and Floriano de Azevedo Marques, both in the lawyers’ seats; Ricardo Villas Bôas Cueva and Sebastião Reis Júnior, both Superior Court of Justice judges.
- For the order (3): Mendonça, court president Kassio Nunes Marques and Dias Toffoli, all Supreme Court justices.
Aranha argued that the video stated no knowingly false facts, Agenda do Poder and BPMoney said. She described it as criticism of a rival’s proposal within democratic debate.
What the Destaque Changes
Agenda do Poder said the destaque takes the case out of the online session, so the count is not final. Poder360 and 98 FM Natal, citing broadcaster CBN, reported that the removal order stays in force until the judgment resumes.
What It Means for US Readers
For holders of New York-listed Brazilian shares like Petrobras, Vale and Itaú Unibanco, the runoff matters more than one video. The real traded near 5.04 per US$ at the central bank’s 14 October rate, the basis for conversions here.
The case also shows that one judge’s order on campaign posts can be challenged by the full court. Travellers face no change, and the Brasília city guide, Brazil’s power structure and its foreign powers and investors give context.

About US$183 million has been traded across Polymarket’s contracts on that election. Both markets price the runoff, not this court case, and the odds guide tracks them.

What Is Not Known
No TSE record of the virtual vote or the destaque could be opened, so the count rests on press reports. The 15 October reports give no case number, so the link to the 13 October order rests on matching content.
Outlets differ on the programmes: Brasil 247 lists Mais Médicos, while Agenda do Poder lists Pé-de-Meia. Em Dia ES dates the order to a Monday, whereas three outlets reported it on Tuesday, 13 October.
The outlets give no campaign reaction, no date for the in-person session and no time for the destaque. Nor is there official word that the removal order stays in force.
What Comes Next
The TSE’s in-person session on Thursday, 15 October, was set for 10:00, and its agenda names three cases, none on this video. The agenda text mentions four cases, so the list may be incomplete.
The runoff is on Sunday, 25 October, ten days away. A ruling on one video does not decide the election, and the issues guide compares what voters choose between.
