Jet Set Nightclub Collapse Timeline and the New Charges

DOMINICAN REPUBLIC · EXPLAINER

The Jet Set nightclub collapse timeline now ends in a ruling that sends the trial back to its start. On 16 October 2026 a judge reclassified the case against owners Antonio and Maribel Espaillat as homicide with eventual intent.

The roof of the Santo Domingo club fell on 8 April 2025 and killed 236 people, with more than 100 injured, according to N Digital. Both are presumed innocent, and every claim below is an allegation until a court decides.

For US readers, the case tests whether a Caribbean court will hold owners personally liable after alleged warnings went unheeded. N Digital’s anniversary coverage counts four US nationals among the 236 dead.

The Jet Set Nightclub Collapse Timeline Step by Step

The collapse struck in the early hours of 8 April 2025, during a concert by merengue singer Rubby Pérez, who died. Prosecutors questioned the owners on 12 June, N Digital’s chronology says, two months and four days later.

On 19 June, after a hearing of more than 12 hours, Judge Fátima Veloz ordered regular check-ins and an exit ban instead of jail. Each sibling had to post RD$50 million (about US$810,000 at the central bank’s mid-October 2026 rate of about RD$61.5 per US$).

Prosecutors and relatives of victims appealed, arguing the measures were too light, and the Court of Appeal confirmed them unanimously on 8 August 2025. Relatives of two victims had already filed complaints on 17 June 2025 seeking a voluntary homicide charge with eventual intent.

Prosecutors built their case on an engineering report that blames repeated overload of the roof, including air conditioners and water tanks. A defence report filed in May 2026 blames gradual beam deterioration and construction defects instead, N Digital says.

How the Case Reached Trial

At the preliminary hearing before Judge Raymundo Mejía, the defence accepted the prosecution’s facts but disputed their legal reading. On 15 June 2026 he sent both siblings to trial for involuntary homicide and involuntary injuries under articles 319 and 320 of the penal code.

Mejía rejected eventual intent, saying Dominican law did not contemplate the concept, though he acknowledged negligence and said the collapse could have been avoided. He kept the coercive measures and ordered assets of RD$500 million (about US$8.1 million at that rate) immobilised to secure compensation.

Wilson Camacho, the Attorney General’s director of prosecution, said 42 of the 54 private complainants backed the accusation as accepted. Lawyers for several other complainants kept arguing that the facts amount to voluntary homicide with eventual intent.

The trial opened on Friday 28 August 2026 before the Fourth Criminal Chamber of the National District. By 11 September Camacho said three prosecution experts agreed that overload caused the collapse, a view the defence contests.

Why the Charge Label Decides the Sentence

Involuntary homicide rests on negligence and carries a much lower ceiling than the three to 20 years now in play. Eventual intent asks whether the owners saw deaths coming and carried on regardless.

Seven lawyers for private complainants asked for a voluntary homicide charge at an earlier hearing, and on 9 October defence lawyer Miguel Valerio answered, Diario Libre reported. He argued that the penal code in force at the time did not expressly contemplate eventual intent.

Judge Franny González Castillo said on 16 October that the evidence heard so far showed documented warnings and a decision to keep the club open, Hoy reports. Prosecutors had kept the milder charge, so the change came at the request of the complainants.

Because the new penalty exceeds the 10-year limit of his chamber, he sent the file to a collegiate tribunal to be drawn by lottery. Our report on the decision is Jet Set Eventual Intent Ruling on 16 October.

N Digital quotes Camacho as saying prosecutors are “more than ready” to show their proof again. The trial that began on 28 August must therefore restart in full.

What It Means for You

Travellers face no new rules from the ruling, which concerns two owners and one nightclub. Nothing in the coverage points to a change in safety rules for other venues.

Families of victims, including those abroad, should expect a longer wait because the trial starts again. We covered the freeze on the owners’ assets in Dominican Republic Court Upholds Asset Freeze in the Jet Set Case.

What Is Not Known

The defence has not been quoted on the ruling in the coverage reviewed, so an appeal is possible but unconfirmed. The drawn tribunal and the start date of hearings are also unknown.

Injury counts differ, with N Digital giving more than 100 in some pieces and 180 in others. No court has settled the dispute between the overload theory and the beam deterioration theory.

Prosecutors asked on 9 October that any change not restart the process, Diario Libre reported, but the judge said it begins from zero, and the coverage does not say whether testimony already given can be reused. No court has found the owners guilty of anything.

Frequently Asked Questions

What happened at the Jet Set nightclub?

The roof collapsed in the early hours of 8 April 2025 during a Rubby Pérez concert in Santo Domingo, killing 236 people. Prosecutors allege the owners overloaded and neglected the structure, which the owners’ experts dispute.

Who are the Espaillat siblings?

Antonio and Maribel Espaillat own the Jet Set nightclub and are the accused in the case. They are presumed innocent and were released under court measures in June 2025.

Why does the trial have to restart?

The new charge carries up to 20 years, above the 10-year limit of the chamber that was trying the case. The file moves to a collegiate tribunal, which must hear the case afresh.

What is the difference between involuntary homicide and eventual intent?

Involuntary homicide covers deaths caused by negligence or carelessness. Eventual intent means foreseeing a deadly result and accepting the risk, and here it carries three to 20 years.

Is a conviction now more likely?

Not automatically, because the judge changed only the legal label and left guilt undecided. The new tribunal must still weigh the evidence from scratch.
