Cockroach Janata Party (CJP) co-convenors Saurav Das and Ashutosh Ranka will not join the Delhi Police Crime Branch investigation on Thursday after informing the agency that they are unavailable and seeking more time, police sources said.
The Crime Branch summoned the two leaders, who were released on Wednesday after giving a written undertaking not to breach peace, in connection with the two separate cases registered against them for allegedly trespassing and obstructing public servants at Jantar Mantar on October 13.
Recently, both cases were transferred to the Crime Branch.
According to Delhi Police sources, Das and Ranka have communicated their unavailability to the investigating team and requested additional time to join the probe.
The Crime Branch is expected to issue fresh summons specifying a revised date and time for their appearance.
The two have also given a written undertaking not to call for protests at Jantar Mantar as long as the site remains denotified. They were directed to furnish personal bonds and surety bonds of Rs 50,000 each until the conclusion of the inquiry.
Das and Ranka were initially sent to five days of judicial custody on October 14 after being detained in connection with the CJP's protest. Their custody was extended by two days on October 19 and expired on Wednesday.
Police sources also said that CJP member Ajinkya Shinde had been summoned in connection with the investigation. The cases concern allegations of trespassing and disobedience of orders issued by a public servant, among other charges.
The CJP leaders have been demanding the resignation of Chief Election Commissioner Gyanesh Kumar over alleged irregularities in the SIR of electoral rolls and the deletion of voters' names.
Das and Ranka were initially detained at the Indira Gandhi International Airport on October 10 ahead of a planned protest. They were released after furnishing peace bonds of Rs 50,000 each.
They were detained again on October 14 after the protest at Jantar Mantar, with police initiating further proceedings over the reported breach of those bonds.
