SOUTH AFRICA · EXPAT GUIDE
South Africa lets skilled foreigners work legally, but the right visa must be approved before you start a job.
Most foreigners need a work visa tied to a job offer, and the two main routes now run on a 100-point test. A bill in Parliament would also make employers prove that no qualified South African is available.
For Americans weighing a move or a posting, the rules reward degrees, experience and scarce skills. This guide explains the routes, the fast-track scheme for employers and the risks ahead.
Key Facts
- —The test Critical Skills and General Work visas need 100 points under rules in force since October 2024.
- —The fast track Home Affairs opened phase two of its Trusted Employer Scheme on 20 July 2026.
- —The remote route A remote work visa needs income of about R650,976 a year (US$39,262), but allows no local job.
- —The risk The Employment Services Amendment Bill, introduced on 29 May 2026, would tighten hiring of foreigners.
- —The rule A tourist or visitor’s visa never allows you to take up work.
Home Affairs is the South African ministry that issues visas. The Critical Skills list names occupations the country is short of. NQF levels rank qualifications, with levels 7 and 8 covering bachelor’s and honours degrees and levels 9 and 10 covering master’s and doctorates. The Trusted Employer Scheme lets approved companies fast-track visas for foreign staff.
How the Points System Works
South Africa brought in a points-based system for work visas in October 2024, after the immigration regulations were amended in May 2024. It applies to the Critical Skills Work Visa and the General Work Visa, but not to intra-company transfers.
An applicant must reach 100 points. A job on the Critical Skills list is worth 100 points on its own.
If you reach 100 through a mix of other points, you receive a General Work Visa instead. The criteria cover qualifications, salary, experience, language and the employer.
Points on offer (as published by law firms)
- Occupation on the Critical Skills list: 100 points
- Qualification at NQF level 9 or 10: 50 points; at level 7 or 8: 30 points
- Gross salary above R976,194 a year (US$58,878): 50 points; from R650,976 (US$39,262): 20 points
- Five to ten years’ experience: 20 points; more than ten years: 30 points
- Job offer from a Trusted Employer Scheme employer: 30 points
- Proficiency in an official South African language: 10 points
The salary bands come from a Home Affairs directive of October 2024, and we found no later change. Employers and immigration lawyers usually run the count before an application.
Always confirm the current thresholds on the Home Affairs website, because salary bands and the occupation list can be updated. Your employer or an immigration lawyer should run the points count before you apply.
Take an illustration using the published points. A candidate with a master’s degree (50), more than ten years’ experience (30) and a salary above the top band (50) would score 130.
A candidate with a bachelor’s degree (30), six years’ experience (20) and a salary in the middle band (20) would score 70. An offer from a Trusted Employer Scheme employer (30) would lift that to 100.
The Trusted Employer Scheme
The Trusted Employer Scheme is a fast track for companies that bring in senior executives, technical staff, corporate employees and investors. Eligibility is tied to investment, local employment and priority sectors.
Participants report 5 to 10 business days in South Africa and up to 20 when filing abroad. Before the scheme, applications took about 22 weeks on average, according to industry reports.
Home Affairs launched the second phase on 20 July 2026. It now includes firms on strategic infrastructure projects, companies setting up regional or global headquarters and qualifying financial-sector entities.
Applicants need at least 80 points under the scheme’s own criteria. If your employer is a member, ask whether you qualify before you start a standard application.
The Remote Work Visa
The remote work visa suits foreigners who work for an employer abroad or earn income from a foreign source. It is a visitor’s visa, not a work permit.
Employed applicants must show income of at least the equivalent of R650,976 a year (US$39,262). Law-firm summaries say the original 2024 rules set a higher figure of R1 million (US$60,314).
Holders may not take a South African job. Those who are tax resident in a country with a double taxation agreement must register with the tax authority once they spend more than 183 days in the country within 12 months.
We explain the rules in our remote work visa guide. Tax is covered in our expat tax guide.

The New Hiring Bill
The Employment Services Amendment Bill was introduced in Parliament on 29 May 2026. It is not law, and it remains before the National Assembly.
Employers would have to satisfy themselves that no suitably qualified South African citizen, permanent resident, refugee or asylum seeker is available. Law firms add that employers would need a skills transfer plan for posts held by foreigners, unless exempt.
The Minister of Employment and Labour could set quotas for specific economic sectors, mainly lower-skilled ones, after public consultation. The bill itself sets no numbers.
The Labour Court would impose fines of up to R100,000 (US$6,031) for a first breach and R200,000 (US$12,063) for a repeat within three years. The top penalty is R1 million (US$60,314) or 10% of annual turnover for multiple breaches.
For foreign staff already in the country, the bill could mean more checks at each renewal. Employers may also ask for more documents before they make an offer.
That is a forecast, not a fact, because the final text is not settled. Follow the parliamentary process if your plans depend on a local job.
Common Mistakes
The most common mistake is to arrive as a tourist and look for work. A visitor’s visa never allows employment.
A second mistake is to treat a points table as fixed. Salary bands and the Critical Skills list change, so rely on the current Home Affairs notice and not on a blog from last year.
A third is to forget tax. Remote workers who stay more than 183 days may need to register, so plan this before the clock runs out.
Starting a Business
Foreigners who want to run a company in South Africa follow separate visa rules that this guide does not cover. Check the current business and investor options with Home Affairs or an immigration lawyer before you move money.
Working for your own company is also work, so a visitor’s visa is not enough. Treat any shortcut offered by an agent with caution.
A Practical Order of Steps
Start with the job offer, because most routes depend on it. Then check whether the occupation is on the Critical Skills list and count your points.
Ask whether the employer belongs to the Trusted Employer Scheme. If it does, the process can be much faster.
Do not start work until the visa is approved, and do not work on a visitor’s visa. Keep your passport valid and your documents in order, and plan for delays.
What It Means for You
For an American professional, a listed skill, a master’s degree or a decade of experience makes the points test far easier. A pay offer above the salary bands helps too.
If you work for a US company and keep your income abroad, the remote work visa avoids the local hiring rules. If you want a local job, watch the hiring bill, because it could make employers more cautious about foreign hires.

What Is Not Known
It is not clear when Parliament will vote on the hiring bill or whether the text will change. The list of critical skills and the salary bands may also be updated.
Processing times vary by case and by office. Treat the 5 to 20 day figure as the scheme’s best case, not a promise.
Frequently Asked Questions
Do Americans need a work visa for South Africa?
Yes, if you will work for a South African employer. A visitor’s visa, including the 90-day visa-free stay for US citizens, does not allow you to take up a job.
How many points do I need for a South African work visa?
You need 100 points under the points-based system in force since October 2024. A job on the Critical Skills list is worth 100 points on its own.
What is the Trusted Employer Scheme?
It is a fast-track scheme for approved companies that hire foreign staff. Participants report processing in 5 to 20 business days, and phase two began on 20 July 2026.
Is the remote work visa a work permit?
No. It is a visitor’s visa for people paid by an employer abroad, with an income floor of the equivalent of R650,976 (US$39,262) a year. Holders may not take a South African job.
Will the new bill stop foreigners from working in South Africa?
Not on its own. The Employment Services Amendment Bill of May 2026 is not law yet, and it would make employers prove no qualified local is available.
