The Supreme Court has sided with Republicans for a second time in a dispute over discounted television and radio advertising rates, allowing the Federal Communications Commission (FCC) to continue reviewing a challenge to its policy without being subject to a lower court-imposed deadline to issue a decision.
The unsigned order, issued Wednesday, comes less than three weeks before the November 3 midterm elections, as Republicans and Democrats compete to reach voters through political advertising.
The court said the FCC would suffer “irreparable harm” if the lower court's order remained in effect. Justices Sonia Sotomayor and Ketanji Brown Jackson said they would have denied the applications for a stay.
The dispute centers on whether political party committees and joint fundraising committees can access the same lowest-unit advertising rates that federal law guarantees to candidates during the 60 days before a general election.
