The Kerala High Court recently directed the Directorate of Social Justice to disburse pending financial aid to a transgender person towards their post-operative treatment after undergoing sex reassignment surgery (SRS).
Justice P.V. Kunhikrishnan allowed the petition, which sought a payment of ₹21,000, with an interest of 18% per annum, pending from a total payment of ₹36,000.
The court noted that the State was awaiting sanction from the authority concerned to disburse the eligible amount to the petitioner. The court directed the State to clear the dues within two months from the date of receipt of the order.
The transgender person’s plea stated that he was from a financially poor background and was unemployed. The petitioner was initially paid ₹62,563 as financial assistance towards the surgery. They cited a Government Order which mandated that transgender persons who underwent SRS were entitled to ₹3,000 per month for a period of 12 months for post-operative treatment and care.
