Thailand’s Securities and Exchange Commission has built a road for spot crypto ETFs. So far, nobody has driven on it.
The regulator says several asset managers have approached it for consultations on launching spot crypto funds. It has not received a single formal application, and it cannot say whether the first Thai crypto ETFs will reach the market in 2026.
What the new framework allows
The groundwork came in the form of 11 notifications that the SEC finalized on October 8, 2026. Those rules took effect on October 16, 2026.
Under the framework, licensed Thai asset management companies can create passive ETFs. Each fund must track one eligible asset rather than a basket of tokens.
The eligible list is short. For now, only Bitcoin and Ether qualify.
The rules also set a floor on how crypto-heavy these products must be. Funds need to hold at least 80% average annual net exposure to their chosen asset.
Listing and custody are tightly ringfenced. The ETFs can trade only on the Stock Exchange of Thailand (SET), and they must use digital asset custodians approved by the SEC.
Guardrails for investors and funds
The SEC paired the new access with a set of investor protections. Anyone buying into these funds must first complete risk education and acknowledge the risks involved.
Leverage is also off the table. Securities firms are barred from offering margin loans for these crypto ETF products.
The most consequential change may be on the institutional side. Thai mutual funds and private funds can now invest in these domestically listed crypto ETFs, within their existing investment limits.
Previously, the path to crypto ETF exposure ran overseas. Access was limited to foreign-access ETFs, and only institutional and ultra-high-net-worth investors could use it.
Why the first mover is still missing
Interest from asset managers is real, according to the SEC. Consultations have taken place with multiple firms.
The SEC has not named any prospective issuers. It has also not set or confirmed any launch timeline.
With the framework effective only from October 16, 2026, a 2026 debut would leave little runway for an issuer to move from consultation to listing.
What this means for Thai markets and crypto
For Thai investors, the immediate change is about plumbing rather than prices. Once a fund lists, buying Bitcoin or Ether exposure could look much like buying any other SET-listed security, without managing wallets or using a crypto exchange.
Mutual and private funds being allowed to hold domestic crypto ETFs creates a potential channel for professionally managed money to reach digital assets through a regulated wrapper. Existing investment limits still apply, so any allocations would come within boundaries the funds already operate under.
Limiting eligibility to Bitcoin and Ether, banning margin and requiring single-asset passive tracking all reduce risk, but they also reduce the room for issuers to differentiate their products.
The key thing to watch now is the first filing. After that, attention will turn to which custodians win SEC approval and how quickly the regulator processes an application. Those details will determine whether Thai crypto ETFs arrive in 2026 or slip into the following year.
