Jay Jay Banda’s Capture: Why Mozambique’s Silence Matters

In their latest statement, the organisations argued that “the legality of prosecuting a fugitive is distinct from the legality of the means used to apprehend him and transfer him between sovereign States.” They invoked Mozambique’s Constitution and legislation governing international judicial cooperation. Interestingly, they also acknowledged uncertainty over whether Banda was extradited, deported or returned through another arrangement. This creates an important distinction between demanding an explanation and establishing wrongdoing.

If the procedure remains unknown, can anyone reasonably conclude that Mozambican law was breached? And what if Mozambican authorities themselves facilitated the operation?

State House, through Chief Communications Specialist Clayson Hamasaka, challenged the organisations’ approach, questioning their treatment of allegations against Banda. Its statement referred to alleged incitement against President Hakainde Hichilema and his ethnic community, alongside other alleged criminal conduct. Hamasaka argued that civil society’s credibility depends on “applying to its own conclusions the same rigour it demands of Government.”

The accusations against Banda remain matters for the courts, but they are not insignificant. The public deserves to understand why the authorities pursued him, just as it deserves assurance that his capture and subsequent detention followed lawful procedures.

The regional political environment offers another perspective. Months earlier, the Zambian government announced Banda’s capture in Zimbabwe and his expected return, but the transfer never materialised. Investigations by The People’s Brief indicated that political intervention in Zimbabwe frustrated the process.

Historically, Zimbabwe’s ruling ZANU-PF maintained close political relations with Zambia’s former ruling Patriotic Front. More recently, Zimbabwean police publicly confirmed cooperation with Zambian authorities in tracing fugitives. What changed between the earlier failed attempt and the latest successful operation? Could improving relations between Lusaka and Harare be changing the circumstances under which Zambian fugitives seek refuge in neighbouring countries?

Mozambique’s position deserves equal consideration. From what we know, Banda was captured through an operation involving a joint Zambian security task force. It is reasonable to question whether an operation involving foreign security personnel could take place on Mozambican territory without prior engagement with its authorities.

If Zambia had violated Mozambique’s sovereignty, would Maputo have remained publicly silent? No official diplomatic protest has been established. Silence alone cannot prove legal compliance, but it is relevant when examining possible cooperation between sovereign governments. Mozambique may even have assisted in locating Banda or facilitating his transfer. Until the circumstances are clarified, these possibilities should not be dismissed.

Beyond the dispute over cross-border procedures lies the question of national security. Banda and other political fugitives have used online platforms to address Zambian audiences from outside the country, with some broadcasts attracting allegations of ethnic hostility and threats. Political criticism is legitimate, but advocacy of ethnic violence is a different matter. Zambia’s history of coexistence among its communities must not encourage complacency about inflammatory political language.

The tragedy of Rwanda demonstrates the danger of organised ethnic incitement. Allegations against Banda must be proved in court, but civil society’s defence of procedural rights should not overshadow the responsibility of the state to investigate credible threats against citizens and national cohesion.

There is also a wider question about the practical enforcement of international law. In January 2026, American forces captured Venezuelan President Nicolás Maduro and his wife during a military operation in Caracas and transferred them to the United States. Amnesty International condemned the operation, but its intervention did not secure their release or reverse Washington’s actions. The circumstances differ from Banda’s capture, particularly because Mozambique has not publicly challenged Zambia’s operation. Nevertheless, the comparison raises questions about the unequal consequences powerful and smaller states face when exercising security powers beyond their borders.
