China wants a say in who gets its best AI. Beijing has proposed adding advanced AI technologies to its export-control list, a step designed to restrict the overseas transfer of AI models and chips, Bloomberg reported.
What’s on the list
The proposal was unveiled on October 16, 2026, by two agencies: China’s Ministry of Commerce and its Ministry of Science and Technology. It covers 40 technologies across three fields: artificial intelligence, biomedicine and photovoltaics.
Those 40 technologies fall into two buckets. Fourteen are marked as prohibited, while the remaining 26 are classified as restricted.
AI dominates the list. It accounts for 23 specific items, which is more than half of the entire draft.
Among the AI entries are large language models, intelligent agents and computing clusters.
The most pointed provision targets model weights and source code. Exports of either would be subject to the rules when the underlying products surpass designated performance thresholds.
In technical terms, weights are the numerical parameters a model develops during training. Hand them over and the recipient effectively gets the finished product, without paying for the training run that produced it.
The public consultation runs until November 15, 2026, giving companies and other stakeholders a window to push back or ask for clarity. Meanwhile, an interim pre-export registration requirement is already in effect for the affected technologies.
Months of groundwork
The proposal did not come out of nowhere. It builds on consultations held in July 2026 with major firms, including Alibaba and ByteDance, which focused on limits around data transfers.
The inclusion of biomedicine and photovoltaics alongside AI is also telling. This is a broader framework for sensitive technologies, with AI as its centerpiece rather than its only target.
What it means for AI companies and investors
The most immediate impact may land on Chinese AI developers with international ambitions. Companies that rely on selling, licensing or deploying advanced models abroad could face new registration steps, approvals or outright limits.
Cross-border partnerships are another pressure point. Any deal that involves transferring model weights, source code or computing cluster technology out of China would need to account for the new regime if it is adopted.
There are several open questions worth tracking. The first is where exactly the performance thresholds land, because that line determines whether the rules hit a handful of frontier systems or a much larger slice of the industry.
The second is how the controls would interact with openly published models. Weights posted for public download are notoriously hard to recall, and how regulators approach that scenario will shape the practical reach of the rules.
The third is what comes out of the consultation period. Feedback from companies like Alibaba and ByteDance, which were already part of the July discussions, could influence the final text before or after the November 15, 2026, deadline.
Finally, watch how the interim pre-export registration works in practice. Since it is already in place, early experience with that process may offer the clearest preview of how strict the final regime will be.
