The Special Court trying former First Vice President Dr Riek Machar and seven co-accused has dismissed an application seeking permission to play a video showing senior government officials.
A panel of three judges rejected the application during the court’s 123rd session on Friday, describing it as premature.
Judge Simon Stephen read the ruling, saying the accused could not yet present evidence in their defence because the charges had not been formally framed.
The application was raised by Dr Machar on October 14 during his cross-examination, when he asked to play the video as part of his defence.
However, prosecution lawyer Ajo Onyo Ohisa objected, arguing that Machar should focus on the charges and present his evidence at the appropriate stage of the trial.
In its ruling, the court directed Machar to follow established procedures and focus on the charges against him.
The judges also cautioned him against commenting on political matters or previous court rulings and decisions.
The court stressed that the Special Court was established to handle a criminal case, not a political dispute, and directed the accused to respect the proceedings and abide by the law.
The panel also warned lead defence lawyer Dr Geri Raimondo against citing incorrect legal provisions or making statements that could mislead the court and the public.
Judge Simon Stephen said the defence lawyer should maintain professional integrity and refer to the relevant legal provisions at the appropriate stage of the proceedings.
The court adjourned the case until October 26, when Dr Machar is expected to continue his cross-examination.
