Accidents caused by a natural disaster, whether from a hurricane, storm, tsunami, or any other type of phenomenon, are covered by many home insurance policies. When these types of cases occur, companies usually pay the required amount to those affected or offer them solutions that ease the losses.
On August 27, 2022, a tree fell on the Cains family's house in the United States. According to the Times of India, the couple had taken out a policy with State Farm, which came to carry out the corresponding report and assess the damage, confirming that the tree had pierced the roof.
In its document, the insurer also included other key sections: it did not include as damage resulting from the tree falling other types of defects, which it linked to long-term problems with the home due to temperatures, maintenance, and the settling of the ground itself.
The errors in the report that ended up being the key to the case
State Farm ended up paying the Cains $10,042.90, a figure far removed from the engineers' reports and a contractor's estimate to repair the home: $95,896.07. It was then that the family challenged the valuation and a dispute began, during which State Farm initially added another $3,130.08.
In June 2024, the legal battle began and the family relied on Sean Fee for their report. This expert, however, requested the repairs but did not include a breakdown of the costs. In addition, he made a mistake by including a colleague, Jim Irmiter, also from Forensic Building Science. Since the family had only officially designated Fee, this ended up creating a new problem.
The United States Court of Appeals for the Fifth Circuit ultimately dismissed Fee's reports and testimony due to those errors and because it considered it impossible to verify who had carried out the analysis. Despite challenging it again, the Cains were left without the compensation and State Farm avoided paying a much larger settlement.
