SEPANG: Malaysia Border Control and Protection Agency (MCBA) director-general Datuk Seri Mohd Shuhaily Mohd Zain will continue performing his duties as usual unless instructed otherwise, his lawyer said.
Datuk Rosal Azimin Ahmad said no administrative directive had been issued to prevent his client from continuing in his role as a public servant, despite facing two charges in court.
However, he said any decision on Shuhaily's position in the public service would be up to the relevant authorities.
"So far, in the absence of any directive, he will continue to perform his duties as usual," he told a press conference after the proceedings at the Sepang court complex.
On the court proceedings, Rosal said Shuhaily had been granted bail of RM1,500 for each charge, amounting to RM3,000 with one surety.
This was lower than the RM5,000 for each charge, or RM10,000 in total, proposed by the prosecution.
"The charging and bail processes have been completed. The court allowed bail of RM1,500 for each charge," he said.
He said the court had fixed Nov 25 for the next case mention, while the defence was awaiting documents under Section 51A of the Criminal Procedure Code.
The defence would review the documents before deciding on its next course of action, including whether to submit representations, he added.
On Shuhaily's reaction to the case, Rosal said his client had accepted the situation and was prepared to face the legal proceedings.
"He accepts what has happened and does not blame anyone," he said.
Earlier, Shuhaily, 54, pleaded not guilty to two charges of voluntarily causing hurt to two Special Branch policemen.
He was accused of causing hurt to Lance Corporals Muhammad Ekmal Sofwan Driman, 25, and Mohamad Faiz Saman, 40, at Counter J on the fifth floor of KLIA Terminal 1 between 1.27pm and 1.35pm on Sept 28.
