Lamarre-Condon double murder trial shown five hours of CCTV

A NSW court has released nearly five hours of CCTV footage showing what prosecutors say are the movements and alleged attempts to cover up a double murder by Beau Lamarre-Condon after he is accused of shooting a young Sydney couple.

Surrounded by shoppers at multiple Bunnings stores in the days following the deaths of Jesse Baird and Luke Davies on February 19, 2024, the footage shows the then-police officer picking out supplies and making cash purchases.

It shows various changes of vehicle from Mr Lamarre-Condon's Tesla, to a hired Mazda, and a hired white van which he allegedly used to transport the men's bodies.

He made various returns to Mr Baird's street in Paddington, where it is alleged Mr Baird and Mr Davies were shot with the defendant's police pistol before their bodies were stored in surfboard bags.

The 31-year-old has pleaded not guilty in the NSW Supreme Court and is arguing self-defence, with his lawyers indicating it is his case the two men died during separate struggles involving the gun in the share house.

Bunnings, surgery and sushi with a friend

The Crown alleged Mr Baird and Mr Davies were murdered on a Monday morning.

On the Tuesday, Mr Lamarre-Condon visited Bunnings in Alexandria for items including gumboots, a drill, hi-vis clothing and dust masks.

He made stops at ATMs and had sushi with a male friend in Cronulla.

On the Wednesday, he was dropped by an Uber at St Vincent's Private Hospital early in the morning for what the jury heard was a minor procedure.

The CCTV compilation shows more stops at ATMs before a trip to Bunnings in Rockdale for a tarpaulin, two sets of white overalls in different sizes, gloves, bin bags, a shovel, a wheelbarrow, and six bags of quick-set concrete.

The court heard that in the afternoon, he picked up a friend known during the trial by the pseudonym Elizabeth Kennedy in a white van.

Ms Kennedy testified they booked accommodation for an upcoming trip before he asked if she wanted to go for a drive.

She recalled the vehicle smelled "lemony" and saw a blue tarp in the back.

Ms Kennedy, who at times communicated with the accused in messages or calls on encrypted app Signal, gave evidence she was told to turn off her phone, and during the two-hour drive to Goulburn, the windows were kept down and the air conditioning was on.

The CCTV shows the pair stopping at Bunnings in Goulburn, where she says Mr Lamarre-Condon asked her to pay for an angle grinder.

According to Ms Kennedy's evidence, they then arrived at a farm which had dams.

She claimed Mr Lamarre-Condon said he knew the owners and had to "break in and save the cattle" which were going to get out.

She said she refused his request to help put garbage bags over the van's number plates.

"I just thought he was up to something," Ms Kennedy told the court.

The witness recalled being left at the gate for 30-to-40 minutes while Mr Lamarre-Condon drove towards a dam on the property, during which time it started getting dark and she had a panic attack.

"I was hyperventilating and crying," she said, recalling how Mr Lamarre-Condon was in gumboots when he returned.

Witness recalls 'freezing' car trip

She described the return to Sydney as "an awful drive" because "it was freezing".

Ms Kennedy said Mr Lamarre-Condon made "cryptic" comments, including about her medication, having nightmares, and whether she had thought about suicide.

She testified he told her he would need to return to Goulburn and would be "up all night", requesting she buy him a peach iced tea for the caffeine.

The blue tarp she previously noticed was gone from the rear of the vehicle, Ms Kennedy said.

The prosecution alleged Mr Lamarre-Condon unsuccessfully attempted to sink the men's bodies in the dam using cement and weights.

They were ultimately found near a monastery in the Bungonia area.

When Ms Kennedy was cross-examined, defence counsel John Stratton SC asked her about her mental health diagnoses, including borderline personality disorder and bipolar disorder.

He suggested, through his questions, an alternative version of the trip, putting to the witness Mr Lamarre-Condon had called her on Signal, told her about the deaths and asked if he should go to police.

But Ms Kennedy denied she replied with: "I watch a lot of crime documentaries — we have to hide the bodies, they won't believe you."

She also rejected suggestions she had made a reference to Taylor Swift by saying it was like the song No Body, No Crime.

"He was the one who put that song on in the car," Ms Kennedy said.

Mr Stratton suggested his client told the witness, before the trip, that "if you don't want to help me, I understand", and lifted the tarpaulin to show her the head of Mr Baird in the van.

"He never mentioned anything about helping him with anything … he definitely didn't want me to know there was anything in the back," she said.

The jury heard Ms Kennedy gave an induced statement to police; representing a promise what she told them could not be used to prosecute her.

She was granted a certificate which had the same effect in relation to her evidence in court.

Jurors heard the arrangement did not extend to protection against potential falsity of evidence or perjury.

During cross-examination, she rejected suggestions Mr Lamarre-Condon had warned her if she helped him she could be charged with being an accessory, saying she did not know anything about the alleged murders.

She denied she had worn one of the pairs of white overalls and a mask, and had used a knife to put holes in a surfboard bag containing Mr Davies's body when it would not sink.

Asked during her evidence-in-chief about repeated attempts to call Mr Lamarre-Condon the following day, Ms Kennedy said she "wanted answers about his behaviour" having seen news about Mr Baird's disappearance.

She claimed a panicked Mr Lamarre-Condon, who was by that point planning to meet with police on the Friday, told her on a call: "If I can't go to Europe with you I'm so sorry, I love you."

"It sounded like a final phone call," she told the jury.

The trial, now in its fifth week, continues on Friday.
