The Madurai Bench of the Madras High Court on Tuesday while disposing of a public interest litigation petition directed the State government to consider a representation made to take appropriate administrative measures to strengthen the Tamil Nadu Probation Wing, including filling up the existing vacancies and assess the need for additional posts.
A Division Bench of Justices P. Velmurugan and K.K. Ramakrishnan directed the State government to consider the representation made by K.R. Raja of Madurai.
The petitioner sought a direction to the State government to conduct a comprehensive and time-bound review of the existing sanctioned strength, vacant posts, working strength, district-wise deployment, workload, court-wise requirement and present functions of the Probation Wing, and take a reasoned decision regarding filling up of vacancies and creation and restoration of posts.
He also sought a direction to the State government to ensure that the Probation Wing was made practically accessible and functional at district and major court levels, with adequate field support, travel facilities, office infrastructure, supporting staff and proper coordination with courts, prisons, District Legal Services Authorities and rehabilitation agencies concerned.
He sought a direction to the State government to take appropriate administrative measures for strengthening the Tamil Nadu Probation Wing, including filling up existing vacancies, assessing the need for additional posts, improving district-level coverage, establishing suitable supervision and aftercare mechanisms, and considering the recommendations of the National Human Rights Commission arising from the National Consultation on the implementation of the Probation of Offenders Act and consider the representation made by the petitioner.
