Cockroach Janata Party (CJP) founder Abhijeet Dipke has been granted conditional bail and will be released shortly after being detained near his residence on Friday while he was marching to join CJP's Lehra Fo Tiranga protest at Connuaght Place's Central Park.
Dipke will be released after signing a peace bond and will not be sent to judicial custody. Notably, CJP activists Saurav Das and Ashutosh Ranka are already in judicial custody after they tried to enter Jantar Mantar area.
Dipke was produced before the Special Executive Magistrate (SEM) court after Delhi Police arrested him in a fresh case of breach of peace under Sections 126 and 170 of the Bharatiya Nagarik Suraksha Sanhita (BNSS).
All India Students' Association (AISA) president Neha Bora was also taken into preventive custody during the 'Lehra Do Tiranga' protest march at Connaught Place on Friday.
Bora was released early Saturday morning after completing the formalities related to her detention under Section 65 of the Delhi Police Act. Dipke, however, remained in custody and was produced before the SEM court.
Dipke had earlier signed a bond undertaking not to disturb the peace for one year after Delhi Police detained him from inside a flight at Delhi airport on October 10. Police had registered a separate breach-of-peace case at the time.
NEHA BORA CALLS DETENTION ILLEGAL
After her release, Bora criticised Delhi Police and the BJP government at the Centre, calling the detentions "illegal". She demanded an end to the Special Intensive Revision (SIR) process and called for Chief Election Commissioner Gyanesh Kumar's resignation, impeachment and imprisonment.
"I was detained at Mandi House and kept here (at the police station) the whole night, until 5 am. Why are you (police) carrying out these illegal detentions? These things have been happening in this country for a long time, and this movement has clearly shown that such detentions are taking place. It has brought these kinds of detentions to light. They claim that they adhere to law and order and go by the book, but none of that is happening," Bora told PTI Videos.
The AISA president also demanded the immediate release of all protesters who had been detained or arrested, including Dipke.
"During this movement, they (police) have been detaining people illegally in the evening and releasing them the next morning or evening. We do not understand which law allows these kinds of detentions. The protesters who have been detained should be released, including Abhijeet Dipke. The sort of curfew that has been imposed in central Delhi should also end," she said.
"Everyone, from Gyanesh Kumar to the BJP government, should shed their arrogance. Gyanesh Kumar should resign or be impeached and jailed, and the SIR should be stopped so that the people of Delhi and India can breathe a sigh of relief," she added.
Following Bora's release, AISA said her release came after 12 hours of protests and outrage across the country over her detention. The organisation thanked the media and people who stood by it during the difficult period.
AISA said its fight for the resignation of CEC Gyanesh Kumar and the rollback of the SIR exercise would continue.
POLICE CITE LAW AND ORDER CONCERNS
On Friday, police sources said officers detained Bora at Mandi House and Dipke at Jhandewalan as they headed towards Connaught Place.
AISA alleged that police moved Bora from one location to another across Delhi for five hours after detaining her before taking her to the RK Puram police station.
The organisation claimed that lawyers reached the police station around midnight but were not allowed to meet Bora. It further alleged that police had not clarified when they would release her and were refusing to provide her medicines despite knowing that she had been unwell for the past few days.
Delhi Police said they had detained around 150 people to maintain law and order and ensure smooth traffic movement.
Security personnel cordoned off Central Park in Connaught Place, with Rapid Action Force personnel deployed inside the park and additional forces stationed in the area.
