Senator Cynthia Lummis has renewed her criticism of Senate Democrats over the stalled CLARITY Act, accusing them of rejecting tougher cryptocurrency penalties and investor protections they had previously requested.
Summary
- Cynthia Lummis has accused Senate Democrats of blocking crypto protections they previously requested.
- The CLARITY Act failed a procedural Senate vote on September 15 by 49–50.
- The disputed provisions cover penalties, customer custody, financial disclosures and exchange capital requirements.
- Democrats have disputed the Republican account, citing unresolved ethics rules and other regulatory concerns.
- Seven Democratic senators have expressed interest in reviving negotiations, but no new vote has been scheduled.
The Wyoming Republican argued that Democrats opposed moving the legislation forward despite changes covering enforcement, customer funds, exchange finances and regulatory capital.
The dispute follows the Senate’s September 15 procedural vote, when the legislation failed to secure enough support to begin formal debate.
Lummis accuses Democrats of blocking CLARITY Act protections
In her October 22 statement, Lummis said Democrats had sought higher civil monetary penalties for digital asset violations, including tougher enforcement involving the Department of Justice.
“The Clarity Act raises them,” she wrote, arguing that Democrats nevertheless opposed bringing the proposal before the Senate.

The Clarity Act raises them.
Democrats voted no on the motion to proceed, effectively saying they felt imposing tougher penalties on crypto crime wasn’t even…
Her criticism continued a series of posts examining individual protections included in the Republican-backed legislation. On October 21, she highlighted provisions requiring formal rulemaking on how digital commodity exchanges safeguard customer funds.
Lummis argued that Democrats had requested custody standards but subsequently opposed advancing legislation containing them.
The proposal would require digital commodity platforms to comply with federal operating standards. A Congressional Research Service review of the September draft confirms requirements for customer assets to remain separate from intermediaries’ own funds, subject to specified exceptions.
The measure would place digital commodity exchanges under Commodity Futures Trading Commission oversight while retaining a role for the Securities and Exchange Commission in certain token transactions.
CLARITY Act includes exchange reporting and capital safeguards
Lummis said the bill would require digital commodity exchanges to submit annual financial statements certified by independent accountants to the CFTC.
Another provision, according to Lummis, would prevent exchanges from creating their own tokens to satisfy regulatory capital requirements, an issue she connected to the collapse of FTX.
— Senator Cynthia Lummis (@SenLummis) October 20, 2026Democrats demanded a direct ban on exchanges creating tokens out of thin air to meet regulatory capital requirements, exactly what FTX did before it collapsed. The Clarity Act writes the FTX rule into law.
Protecting consumers from another FTX-style collapse still wasn’t enough…
The senator argued that preventing another exchange failure should have been sufficient reason to begin debating the bill.
A review of the Senate draft confirms that the legislation contains customer-asset safeguards, exchange registration requirements and provisions addressing conflicts of interest.
The Congressional Research Service described a framework in which registered exchanges would follow operational standards, including restrictions intended to reduce manipulation and protect customer property.
However, Lummis’s argument concerns the political meaning of the September vote. Rejecting a procedural motion does not constitute a separate Senate vote against each consumer protection contained in a proposed bill.
The provisions remain proposals because the CLARITY Act has not become law.
Democrats dispute why the crypto bill failed
The Senate rejected cloture on the motion to proceed on September 15 by 49 votes to 50. The motion required 60 votes, leaving supporters 11 short of the threshold for opening debate.
Official Senate voting records confirm that four Republicans joined Democrats in voting against the motion. Republican Senator Thom Tillis changed his vote to preserve the possibility of reconsideration.
Democratic lawmakers have offered a different explanation for their opposition.
Senator Ruben Gallego argued that Republicans failed to accept stronger restrictions addressing President Donald Trump’s cryptocurrency interests. Senator Catherine Cortez Masto raised concerns about enforcement authority, prediction markets and ethics provisions.
The disagreement followed months of negotiations over whether elected officials and their families should face restrictions on benefiting financially from digital asset ventures.
Before the vote, Lummis and Republican committee leaders released a revised draft they said incorporated 126 substantive changes requested by Democrats.
As crypto.news previously reported on negotiations, unresolved ethics questions remained a central obstacle despite agreements on several other provisions.
Can the CLARITY Act return before the end of 2026?
Although the September vote prevented immediate consideration, it did not permanently prohibit another attempt.
Seven Democratic senators subsequently expressed interest in continuing negotiations. Their effort to revive talks followed a joint statement describing the unsuccessful vote as not the end of work on cryptocurrency market structure.
Any renewed attempt would still need a coalition capable of securing 60 Senate votes, followed by the remaining legislative steps.
Meanwhile, the Securities and Exchange Commission and CFTC have continued developing cryptocurrency regulations within their existing authority.
The regulatory response to the setback has included proposed SEC rules addressing digital asset offerings and exemptions, although agency regulations cannot independently enact every provision contained in the legislation.
Republican Representative French Hill has argued that rules written by regulators cannot provide the same lasting legal framework as legislation passed by Congress.
Senator Tillis’s motion to reconsider remains a procedural route for another vote. As of October 23, Senate leaders had not announced a new cloture date or a revised agreement resolving the outstanding disputes.
