ICPC vs El-Rufai Aide Jimi Lawal: What We Know

EXPLAINER · NIGERIA

The El-Rufai aide at the centre of a new bail fight is Jimi Lawal, a former senior special adviser to ex-Kaduna governor Nasir El-Rufai. On Wednesday 14 October, Nigeria’s Independent Corrupt Practices and Other Related Offences Commission (ICPC) told a federal court it opposes his release.

The hearing took place at the Federal High Court in Kaduna, the capital of a large state in northern Nigeria. For foreign readers, the case is a test of how Nigeria handles corruption charges against a leading opposition figure ahead of the 2027 elections.

Lawal is the second defendant in a money laundering case in which El-Rufai is the first. Both men have pleaded not guilty, and the allegations against them have not been tested at trial.

What the ICPC Alleges Against the El-Rufai Aide

The ICPC is the federal agency that investigates and prosecutes graft by public officials, and it is led by Musa Aliyu, a senior lawyer. It filed the case on 17 April and arraigned the defendants in June on an amended 11-count charge, the commission said in a statement.

According to the charges as reported by Premium Times, El-Rufai approved a CCTV contract worth N8.68 billion (about US$6.5 million) in December 2015. The ICPC alleges the contract went to Singularity Network Security Limited, a firm it says lacked the experience the job required.

The April charge sheet also alleged that Lawal and two companies received N925 million (about US$694,000) in suspected illicit proceeds in October 2019. Lawal pleaded not guilty to counts six, seven and eight, while El-Rufai pleaded not guilty to count one.

What Happened in Court on Wednesday

ICPC prosecutor Ibrahim Mukhtar told reporters the agency had filed a counter-affidavit against Lawal’s bail request. “We are opposing the application,” he said, according to Punch.

Mukhtar declined to give the grounds, saying the prosecution had not yet argued them before the judge. He described the charges as alleged financial misconduct involving about seven counts and said no witness had yet testified.

Lawal’s lawyer, Obong Okon, asked for bail on medical grounds, adding that only a living person could stand trial. He argued the ICPC could not reasonably object after it had earlier granted Lawal administrative bail, the News Agency of Nigeria reported via Peoples Gazette.

The prosecution asked for time to study a further affidavit from the defence, which was served on Wednesday afternoon. El-Rufai’s new counsel, Mustapha Abubakar, a senior advocate, said both sides agreed to the delay in the interest of a fair hearing.

Why the Bail Fight Matters

El-Rufai himself has been in ICPC custody since 18 February under court-ordered remand, Premium Times and The ICIR report. On Friday 9 October, the Court of Appeal in Kaduna upheld a state court’s refusal to grant him bail.

He also faces a separate ICPC case at the Kaduna State High Court over alleged abuse of office and money laundering. Premium Times says the prosecutions stem largely from a 2024 Kaduna State House of Assembly probe of his administration.

In that state case on Tuesday, a forensic witness from the State Security Service alleged that El-Rufai planned to pay US$600,000 to stall an investigation by another agency, the EFCC. Premium Times stressed the claim is prosecution evidence that the court has not yet established.

El-Rufai’s lawyer, Paul Erokoro, objected that the defence had not been told the witness would appear, but Justice Darius Khobo allowed the testimony. That trial resumes on 30 November and 1 December.

El-Rufai maintains that his prosecution is politically motivated. He is deputy chairman of the campaign council of Atiku Abubakar, the former vice president running for the opposition African Democratic Congress (ADC).

What It Means for US Readers

Premium Times reports that the witness also described plans to keep the EFCC away from a company listed on the New York Stock Exchange, which it did not name. The April charge sheet, as reported by the same paper, named an executive of tower operator IHS, whose parent trades in New York.

That executive was not among the defendants arraigned in June, according to Premium Times and Daily Trust. No US company has been charged, and none has been accused of wrongdoing by a court.

For investors, the trials are a gauge of whether Nigeria’s anti-graft agencies act independently of politics before the 2027 elections. The US State Department rates Nigeria at Level 3, “reconsider travel,” citing crime, terrorism, unrest and kidnapping.

What Is Not Known

The ICPC has not said publicly why it opposes bail for Lawal, and the nature of his illness has not been disclosed. It is also unclear whether he is in detention, although he was brought to court under heavy security.

The number of counts is uncertain, because the prosecutor spoke of about seven counts while the June arraignment involved 11. It is also not known whether the judge will rule on Friday or reserve the decision for a later date.
