The foundation argues regulators should fix existing gaps in crypto rules rather than pull staking and decentralized finance under MiCA's scope.
The Cardano Foundation has called on European Union officials to prioritize fixing existing flaws in the Markets in Crypto-Assets regulation. The foundation argues against extending the framework to cover decentralized finance and crypto staking at this time.
MiCA took effect as the EU's comprehensive attempt to regulate crypto-asset markets. It established licensing requirements, consumer protections, and operational standards for exchanges, stablecoin issuers, and other centralized crypto service providers. The framework has been held up internationally as one of the first broad regulatory regimes for digital assets.
According to reporting from Cryptopolitan, Cointribune, and CoinGape, the Cardano Foundation believes MiCA still contains unresolved gaps. Rather than widening the regulation's scope, the foundation wants regulators to focus on correcting those existing issues first. The group's position suggests current enforcement or implementation challenges remain unaddressed within the current rulebook.
The foundation's stance specifically pushes back against folding DeFi protocols and staking activities into MiCA's regulatory perimeter. Decentralized finance platforms operate without centralized intermediaries, relying instead on smart contracts and automated code. Staking, meanwhile, involves locking crypto assets to support network security and validation, often in exchange for rewards.
Applying traditional licensing and custody requirements to these decentralized structures raises practical questions. DeFi protocols frequently lack a central entity that could hold a license or bear regulatory liability in the way MiCA envisions for centralized firms. Staking mechanisms also vary widely across blockchain networks, complicating any uniform regulatory treatment.
The Cardano Foundation's intervention reflects a broader industry debate playing out across Europe and beyond. Many blockchain organizations worry that regulation designed for centralized entities could be poorly suited to decentralized systems. Applying such rules without adaptation, they argue, risks stifling innovation or pushing development outside the EU entirely.
European regulators have signaled ongoing interest in reviewing MiCA's coverage as the crypto market evolves. Any formal move to expand the regulation's scope would likely involve extended consultation periods and industry feedback. The Cardano Foundation's public position adds another voice to that conversation, ahead of any formal rulemaking process.
Market Impact
A decision by EU regulators on whether to expand MiCA into DeFi and staking could influence where decentralized projects choose to base their operations. Clearer or narrower rules might encourage continued development within the bloc, while overly broad requirements could push some protocols toward jurisdictions with lighter oversight.
For Cardano specifically, which supports staking as part of its proof-of-stake consensus mechanism, regulatory clarity carries direct relevance. Staking service providers and validators operating in or serving EU users would face new compliance considerations if MiCA's scope were broadened. Market participants are likely to watch for formal EU proposals or consultation papers addressing this question in coming months.
The Cardano Foundation's comments add to an ongoing debate about how far EU crypto regulation should reach into decentralized systems. Whether regulators choose to amend MiCA's existing provisions or expand its scope remains an open question for the industry to watch.
Frequently Asked Questions
What is MiCA?
MiCA, or Markets in Crypto-Assets, is the European Union's regulatory framework governing crypto-asset issuers and service providers, covering licensing, consumer protections, and operational standards.
What is the Cardano Foundation asking EU regulators to do?
The foundation is urging the EU to address existing gaps and issues within MiCA rather than expanding the regulation to cover decentralized finance and crypto staking.
Why does the foundation oppose bringing DeFi under MiCA?
DeFi protocols typically lack a central entity to hold licenses or bear regulatory responsibility, making traditional MiCA-style requirements difficult to apply in their current form.
Does this mean staking is currently unregulated under MiCA?
The reports indicate the foundation wants staking kept outside MiCA's expanded scope, suggesting it is not currently covered under the regulation's existing framework in the way centralized services are.
