The Trump administration has shortened the time refugees have to defend their legal status in the United States, introducing a ten-day response period that could affect African arrivals who have not yet obtained permanent residency.

The measure replaces a 30-day deadline for responding when immigration officials issue a notice that they intend to terminate someone’s refugee status.
The Department of Homeland Security released the rule on 13 October, with publication and commencement scheduled for 14 October.
The change concerns cases in which officials determine that a person did not qualify as a refugee when admitted. It does not automatically remove the status of everyone who entered through the resettlement programme.
According to the original DHS rule, approximately 186,000 refugees admitted during fiscal years 2015–2025 have not become permanent residents. The department identifies that worldwide population as the maximum potentially subject to the measure, rather than a deportation target.
The African connection
Official US admissions records show that the refugee programme has resettled people from the Democratic Republic of Congo, Eritrea, Ethiopia, Somalia and South Sudan, among other African countries.
For members of those communities who remain within the rule’s scope, a notice of intended termination would leave substantially less time to gather evidence and respond.
However, the government document does not identify how many Africans could be affected. It would therefore be inaccurate to describe the entire 186,000-person pool as African or to suggest that all members face imminent removal.
Less time to obtain help
Refugee organisations argue that the shorter period could make it harder to find legal representation, translate documents or obtain records from countries people fled.
In a statement dated 13 October, humanitarian organisation HIAS opposed the change and warned that refugees without green cards could face increased insecurity.
The government says the measure is intended to address improper admissions and protect the integrity of the refugee programme. Its claims about weaknesses in earlier screening are disputed by refugee advocates.
The change shortens the time available to challenge a termination notice by two-thirds, leaving affected individuals less time to defend their status. Losing refugee status could expose them to immigration enforcement, but the shorter deadline does not itself constitute a deportation order.
