- China's National Immigration Administration published the official grounds under which a foreigner's residence permit application can be refused
- The five-point list covers everything from visa category mismatches to fraud and failure to submit required documents
- Authorities noted that decisions to refuse a residence permit are final, with no right of appeal under Chinese law
China's National Immigration Administration has outlined five specific circumstances under which foreigners can be refused a residence permit, publishing the conditions on its official website.
The guidance draws on Article 31 of the Exit and Entry Administration Law of the People's Republic of China and sets out clear grounds for rejection that applicants need to be aware of before submitting any documentation.

1. The first ground for refusal is a mismatch between the type of visa an applicant holds and the category of residence permit they are seeking. Not every visa qualifies a foreign national to proceed with a residence permit application.
2. The second ground relates to conduct. An applicant who is found to have provided false or misleading information during the application process will be refused.
3. Anyone who fails to submit the correct supporting materials as required under the relevant rules will also be refused.
4. The fourth circumstance concerns legal compliance. Foreigners who have violated Chinese law or administrative regulations may be deemed unfit to reside in the country, and a permit will not be granted on that basis.
5. A fifth, broader ground covers any other situation in which the relevant authority considers it inappropriate to issue a residence permit. This provision gives officials discretionary authority beyond the four specific categories listed above.
China residence permit: Refusal decisions are final
One aspect of the rules that carries significant weight for applicants is the finality of these decisions. Under Article 36 of the same law, any decision by an exit and entry department of a public security organ to refuse, decline to extend, or decline to reissue a residence permit is considered final. There is no formal appeals process outlined for overturned decisions.
The administration did note one avenue available to a narrower group of applicants. Professionals and investors who meet certain state requirements, as well as foreigners seeking to convert from a stay permit to a residence permit for humanitarian reasons, may apply for a foreign residence permit with approval from the entry and exit department of a public security organ at prefecture level or above.
The guidance serves as a practical reminder that residence permit applications in China require careful preparation, honest disclosure, and an understanding of which visa categories are eligible to begin the process in the first place.

Citizenship: Australia mentions residency years for foreigners
Meanwhile, Legit.ng previously reported that Australia's Department of Home Affairs outlined the residence requirement foreigners must meet before applying for citizenship.
Applicants must have lived in Australia on a valid visa for a number of years before the date they apply for citizenship.
The rules also specify how much time applicants are allowed to have spent outside Australia during that period.
