US President Donald Trump’s decision to indefinitely postpone statutory sanctions and tariffs targeting Russia has triggered condemnation from lawmakers across both parties, though formal congressional intervention remains stalled due to the pre-election legislative recess, the Associated Press reported.
Congress previously passed the sanctions package with overwhelming veto-proof majorities, reflecting broad bipartisan backing for Ukraine and international deterrence.

However, Trump’s executive order on Friday, Oct. 16, waiving enforcement just 48 hours before statutory enactment ignited pushback among key Republican and Democratic legislators.
Despite the outrage, lawmakers are not positioned to mount an immediate legislative response, as both the Senate and the House of Representatives remain in recess until after the crucial Nov. 3 midterm elections.
Republican fury and challenges to energy rationale
Senior Republicans voiced open frustration over the administration’s decision to shield Moscow from statutory trade duties and secondary financial penalties.
Republican Senator Thom Tillis characterized the executive waiver as “more than irresponsible,” pointing out that the Senate enacted the statute by an overwhelming 86-11 margin. Tillis accused the White House of offering unwarranted concessions to Russian President Vladimir Putin while undermining congressional prerogatives.
Tillis further pushed back against the administration’s economic defense, stating that if the White House seeks to reduce domestic energy prices, policymakers must focus on resolving the armed conflict involving Iran rather than enacting commercial steps that subsidize Russia.

Democratic leadership pledges congressional pushback
Democratic leaders similarly condemned the indefinite suspension, warning that easing economic pressure underwrites the Kremlin’s wartime economy and sustains long-range bombardments against Ukrainian civilian population centers.
Senate Democratic Leader Chuck Schumer accused Trump of directly propping up the Russian economy at the expense of American allies and democratic norms.
Senator Elizabeth Warren stated that the president is openly defying Congress, asserting that waiving statutory enforcement enables Putin to prolong an aggressive war of conquest.
Warren urged lawmakers to prepare legislative mechanisms to reverse the executive order once Congress reconvenes in Washington following the November vote.
The Associated Press reported that Trump suspended the penalties indefinitely, citing US national security considerations under statutory waiver authorities.
Because members of Congress are dispersed across their home districts campaigning ahead of the Nov. 3 balloting, any formal legislative counter-measures – such as the bipartisan “Prohibit Corrupt Russia Oil Deals Act” introduced by Representative Gregory Meeks or the “Ronald Reagan Peace Through Strength Act” drafted by Representatives Brian Fitzpatrick and Don Bacon – will face procedural delays until post-election sessions commence.
Background on the Graham Act and the diesel deal
Trump’s executive action waives core enforcement mechanisms codified within the Lindsey O. Graham Sanctioning Russia and Iran Act of 2026, which the president signed into law on Sept. 18.
The suspended provisions, which were scheduled to take statutory effect on Sunday, Oct. 18, mandated an additional 500 percent tariff on all Russian-origin imports alongside 100 percent duties targeting the five largest global purchasers of Russian crude oil and natural gas, including China and India.
The statute also required trade penalties against third-party nations facilitating petroleum sanctions evasion and established aggressive actions to dismantle Moscow’s maritime “shadow fleet.”
In issuing the waiver, Trump invoked Section 115 of the statute, which grants executive discretion upon certifying to Congress that such action serves US national interests.
The suspension aligns with a commercial arrangement unveiled on Oct. 9 between Trump and Putin, under which Moscow consented to export refined diesel onto international markets through 2027 to lower retail fuel costs.
The waiver was met with condemnation from Kyiv, where President Volodymyr Zelensky warned that lifting economic penalties constitutes a grave policy error that provides financial lifelines to the Russian military and signals to Moscow that persistent infrastructure bombardments will carry no economic consequence.
