The Office of the Director of Public Prosecutions (DPP) secured the verdict after prosecutors Sonia Njoki, Hillary Isiaho, and James Murage presented nineteen witnesses alongside documentary and expert evidence spanning five counts.
The Charges Against Chelogoi
Chelogoi was found guilty of conspiracy to defraud, forcible detainer, two counts of forgery, and one count of uttering a forged document.
The court established that he had conspired to deprive Ashok Rupshi Shah and Hitebkumar Amritlal Raja of their lawfully registered property, known as Nairobi/Block/80/44, a parcel measuring approximately 7.390 hectares along Lower Kabete Road.
At the centre of the case was a letter of allotment dated January 31, 1995, which the court determined had been fabricated to mimic an authentic document issued by the commissioner of lands.
The court further found that on October 11, 2023, at the Directorate of Criminal Investigations headquarters along Kiambu Road in Kiambu County, Chelogoi knowingly presented the forged allotment letter alongside a certificate bearing a falsified signature and stamp impression attributed to Paul Achieng Pesa, representing them as genuine land documents issued by the Commissioner of Lands and the State Department of Lands and Physical Planning.
Remand and Land Ruling
Chief Magistrate Dolphina Alego cancelled Chelogoi's bond following the conviction and ordered that he be held at Nairobi Remand Prison pending a mitigation and sentencing hearing scheduled for November 2, 2026.
Beyond the criminal verdict, the court issued a civil order directing the land registrar to nullify any parallel title or registration that had been entered against the property. The court declared that the land rightfully belongs to Ashok Rupshi Shah and Hitebkumar Amritlal Raja.
