A recent Madras High Court judgement gave back 36 cents of land to two brothers after it was proved that their sister’s husband sold it using an invalid gift deed under Hindu law.
Justice R. Sakthivel of Madras High Court said in his judgement that the gift of an immovable property can be made only through a registered instrument attested by at least two witnesses. The only exception is under Section 129 of the Transfer of Property Act, 1882, which exempts gifts under the Muslim law from mandatory registration. For Hindus, Section 123 of the Transfer of Property Act, 1882 applies, requiring all gifts to be properly registered and attested.
In this case, the sister claimed the father’s 36 cents of land on the basis of an oral gift with no registered deed. When her husband’s family sold the land based on this oral gift, the brothers got angry and filed a court case on April 30, 1987.
After a long discussion, the Madras High Court ruled on September 2, 2026, that since all parties in this case are Hindus, the oral gift is invalid under Hindu law. Because the gift deed itself is invalid, the subsequent sale of the land is also invalid. On this ground, the brothers won back the title of their father’s land. Now, the brothers need to start the eviction process to remove the current owner.

Details of the family
According to the court submissions, Mr Rangi Chettiar purchased 1/4th share of a land measuring 2 acres 28 cents from Mr Kempana Gounder through a sale deed dated July 24, 1922.
On September 22, 1947, Rangi Chettiar's son, Kumara Chettiar, executed a registered Settlement Deed in respect of his family properties, including 1/4 share in Suit 'A' schedule property, in favour of his two sons, R.K.Thimmi Chettiar and R.K.Rangasamy Chettiar. The mutation records were updated in their names and since then they remained in possession.
Kumar Chettiar also had a daughter, Mrs Venkattammal (sister of R.K.Thimmi Chettiar and R.K.Rangasamy Chettiar), who denied execution of any such settlement deed. She instead claimed that her father gave up this land to Mr T.Rangasamy Chettiar, who is her husband, via an oral gift.
The dispute got more complicated when for unknown reasons, the government ordered a re-survey of all the lands in the village, after which the records erroneously showed that this 36 cents of land belonged to T. Rangasamy Chettiar, Venkattammal’s (the sister’s) husband.
Based on this wrong record entry in land survey records, T. Rangasamy Chettiar’s family sold the land to another person on January 29, 1987. This person who purchased the 36 cents land claimed to own it on the basis of this sale.
Why did the sister's side lose the case?
Navod Prasannan, Partner at King Stubb and Kasiva, said to ET Wealth Online: The main fight was whether the 36 cents land was actually transferred to the sister's husband. The sister's side claimed it was given to him orally, but they were never consistent - at one place they said it was an oral sale, at another an oral gift, and at another a family arrangement. The brothers disputed this completely and said they still have a share. The High Court looked for solid proof of transfer and found nothing reliable to support the sister's side.
The biggest legal hurdle was the Transfer of Property Act angle. Since the parties are Hindus and the property is immovable, any claim of gift has to satisfy Section 123 of the Transfer of Property Act. Prasannan says that Section 123 says that for Hindus you cannot gift immovable property just by oral understanding; it must be made through a registered document which is properly attested by witnesses.
Because there was no such registered deed, the Madras High Court held that no valid gift had taken place in the eyes of law.
The Madras High Court also examined the revenue records which the sister's side was heavily relying on. It found that in the subsequent re-survey the land was incorrectly reflected, and the patta entry in favour of the sister's side was made without giving any notice to the brothers.
So, the Madras High Court refused to treat that patta as proof of ownership. Prasannan says that the brothers succeeded because they could show better property records and possession, while the sister's side failed to establish any legally valid transfer.

Prasannan says that Hindu families should never leave property matters to oral understandings, no matter how good the relations are at that time. What seems like mutual trust today becomes very difficult to prove years later when disputes arise, especially when the original elders are no more.
Prasannan says: "If you want to gift immovable property to a family member or divide property among yourselves, it must be properly documented and registered in accordance with law."
Prasannan says that this Madras High Court judgment also reminds us not to blindly trust patta or revenue records. A patta by itself does not decide ownership and can be entered wrongly. Families should keep checking their land records, particularly after a re-survey, and should raise objections at the right stage if they see a wrong entry.
Madras High Court discussion
No notice for re-survey proceedings were given to the brothers
The Madras High Court ruled that the authorities constituted under the
Tamil Nadu Survey and Boundaries Act, 1923, ought to have issued notice under Section 9(2) before conducting survey and ought to have informed their decision under Section 10(2) to the registered holders i.e. the brothers. However, no such notice was given to the brothers. So, they were not bound by the decision to record the sister’s husband as owner of this land.
Gift of Hindu property can only be made using registered instrument
The Madras High Court observed that the father T.Rangasamy Chettiar, and the other heirs all belong to Hindu religion. Hence Section 123 of the Transfer of Property Act, 1882, shall be applicable to the parties. Thus if the contesting person’s stand is based on an oral gift, then reference must be made to Section 123 of the Transfer of Property Act, 1882.
Madras High Court said that a gift of an immovable property can be made only through a registered instrument attested by at least two witnesses. Moreover, under the Registration Act, 1908, it is mandatory to register a gift of immovable property and the distinction of property being more than or equal to Rs 100 does not apply to a gift in case of immovable property.
Oral partition can only be made if the party making it had any pre-existing right to that property
The Madras High Court said that if the contesting defendants' stand is oral partition, it is settled law that partition can be effected only among persons with preexisting rights. There is nothing available on record to show that T.Rangasamy Chettiar had any pre-existing interest or right over the ¼ share in Suit 'A' schedule property in any manner. Nor are there any pleadings to that effect. Hence, Madras High Court said that they are of the view that, if the contesting defendants' stand is oral partition, it must also fail.
The brothers established their case by way of Preponderance of Probability
The Madras High Court said that the contesting defendants have failed to establish their case. There is no evidence available on record to show that T.Rangasamy Chettiar or the contesting defendants were in possession and enjoyment of the property prior to the re-survey.
Hence, the Madras High Court said that they are of the view that the brothers have successfully established their case. Therefore, the Patta issued in favour of T.Rangasamy Chettiar under Re-Survey is invalid and not binding upon the brothers.
The Madras High Court said: “Consequently, the Sale Deed dated January 29, 1987, executed by the legal heirs of T.Rangasamy Chettiar, namely defendants 13 and 14, in favour of the fifteenth defendant is also invalid and not binding upon the brothers.”
