EMMANUEL JAY JAY BANDA’S RIGHTS MUST BE PROTECTED – NGOMA
The Acton Institute for Policy Analysis Centre (AIPAC) says the rights of former Petauke Central Member of Parliament Emmanuel Jay Jay Banda must be protected throughout the legal process.
AIPAC has welcomed the arrest of former law maker while calling for respect for the rule of law and constitutional institutions.
AIPAC Executive Director Solomon Ngoma told Sun FM that the joint operations by security and law enforcement agencies reflected their constitutional mandate.
Ngoma said freedom of expression, although guaranteed under Zambia’s democratic framework, must be exercised responsibly and within the confines of the law.
The arrest of Banda should not prejudice his right to a fair hearing, Ngoma stressed, adding that legal representation and due process as guaranteed under the Constitution and laws of Zambia.
He cautioned against the misuse of democratic freedoms in ways that could undermine state institutions, incite public disorder or threaten national unity.
Ngoma urged Zambians to exercise restraint and patriotism when expressing divergent views on national matters, emphasising that democratic rights come with corresponding responsibilities.
He also warned that individuals accused of committing offences should not assume that residing outside Zambia places them beyond the reach of justice, noting that international cooperation enables governments and law enforcement agencies to pursue alleged offenders through established legal channels.
He said AIPAC expected the matter to be handled professionally, fairly and transparently, with Mr Banda given an opportunity to answer to the allegations before a competent court.
Mr Ngoma emphasised that the determination of guilt or innocence rests with the courts, which must act independently and in accordance with the law.
He called on Zambians to uphold constitutional institutions anmd safeguard democratic values, stressing that justice must be administered without fear, favour, prejudice or political consideration.
