With the Texas Senate race entering its final stretch in a virtual dead heat, attention is increasingly turning to Libertarian candidate Ted Brown, whose share of the vote could match the margin separating Democrat James Talarico and Republican Ken Paxton.
A recent University of Houston Hobby School poll found Talarico leading Paxton 48 percent to 46 percent, while Brown drew 3 percent of the vote.
Talarico, a Democratic state representative from Austin, is attempting to become the first Democrat elected statewide in more than three decades. Paxton, the state's attorney general, won the Republican nomination after defeating longtime U.S. Senator John Cornyn in a bitter primary campaign. However, he entered the general election carrying years of political baggage, including an impeachment by the Texas House and previous securities fraud charges that were later resolved.

"Brown will be a refuge for Texas Republicans who cannot bring themselves to vote for Ken Paxton or for James Talarico, and don't want to leave the first spot on the ballot blank," Mark Jones, a political scientist at Rice University, told Newsweek.
Jones said recent polling found that roughly half of Brown's supporters were independents and half were Republicans, while "virtually none of them are Democrats."
Brown, a 66-year-old retired insurance adjuster from Austin, has spent nearly five decades advocating for core Libertarian principles: limited government, individual liberty and a non-interventionist foreign policy. While Brown rejects the label, political observers say he could play a spoiler role if his vote share exceeds the eventual margin between Talarico and Paxton.
"I don't think you can spoil something that's already rotten and putrid to begin with, and that's our two-party system that gets some of the worst candidates nominated," he said in a recent interview with East Texas Now on KLTV. "Ken Paxton's a good example of that. I mean, he's a terrible candidate. He's corrupt. He has a history of being indicted, impeached, accused of official misconduct."
Newsweek reached out to both the Paxton and Talarico campaigns by email for comment.
Will Anti-Paxton Republicans turn Libertarian?
Brown said he is getting pressure from both Republicans and Democrats.
"I have as many Talarico supporters and Paxton supporters each saying that I'm taking votes from their guy and urging me to drop out," Brown told Newsweek. "But I think Paxton's side does have a little bit more to worry about…I know a lot of those folks. They're considering voting for James Talarico, but come on. They're lifelong Republicans. Are they really going to vote for him?"
He cautions against oversimplifying Libertarian voters.
"If there's no Libertarian in the race, Libertarian voters are about a third, a third and a third," he said. "A third would vote for the Democrat. A third would vote for the Republican. And a third wouldn't even vote in that race at all."
Jones' polling analysis paints a different picture. A large sample found that in Harris County, where Houston is located, more than two-thirds of Brown supporters backed the Republican county judge candidate, while only about one in 10 supported the Democratic candidate.
"In Texas, Libertarian candidates pull far more from Republicans than they do from Democrats," Jones said.

But analysts caution against treating every Brown voter as a Republican defector.
"Brown's candidacy illustrates the difference between partisan dissatisfaction and partisan defection," Brandon Rottinghaus, a political scientist at the University of Houston, told Newsweek. "Some voters may be unhappy with their usual party but unwilling to support the opposition. A Libertarian candidate provides an alternative that allows them to register dissatisfaction without crossing directly into the other major party's column."
Rottinghaus added that "the mistake is assuming every Libertarian voter is simply a Republican who hasn't come home yet."
Could Brown Change the Outcome?
When he unsuccessfully challenged Senator Ted Cruz in 2024, Brown received more than 267,000 votes, a record for a Libertarian Senate candidate in Texas. Asked what success would look like this year, Brown said that beyond winning the race, he hopes to surpass his previous performance, raise voters' awareness about the Libertarian Party and "set the stage" for future growth.
Rottinghaus noted that Texas Libertarians historically have not determined statewide Senate outcomes.
"No Texas U.S. Senate election featuring a Libertarian candidate had produced a Libertarian vote share equal to or greater than the major-party victory margin," he said.
But he added that 2026 may present a different scenario.
"In a close race like this cycle, even the shift of 100,000 votes could make the difference," Rottinghaus said.
Brown is likely drawing more support from Republicans than Democrats, making his candidacy "a small but perhaps meaningful boon to Talarico," Cal Jillson, a political scientist at Southern Methodist University, told Newsweek.
"Brown has been polling in the low single digits while Talarico has been leading Paxton by a little more than two points," Jillson said. "So, yes, Brown could affect the outcome but not likely change it."
Brown knows that he's likely to take some blame on November 3.
"If it's decided below 50 percent and I'm the difference between the two, then whoever loses is going to blame me," he said. "Let the chips fall where they may."
