PETALING JAYA: A shop owner has been sentenced to a week in prison by the Ayer Keroh magistrates' court for disorderly conduct at a police station in Melaka.
Magistrate Nur Afiqah Radhiah Zainurin handed down the sentence on Ong Bing Hong after finding her guilty of the charge under Section 90 of the Police Act.
Ong was charged with behaving in a disorderly manner by provoking a police officer on duty at the Malim police station on Jan 12, 2024.
According to the facts of the case, she tried to stop Fairos Mustar from receiving a police report from three people over a suspicious tyre sale.
Ong claimed the three persons had broken into her shop, and wanted Fairos to arrest them.
In response, Fairos said he had no authority to arrest the men as they had not committed an offence.
The three individuals and Ong's son were also told to remain at the station for their statements to be recorded.
Dissatisfied with the answer, Ong caused a commotion at the station, pointed her fingers at the counter officers, and screamed while recording a video.
She also threatened to spread the video to the public.
In finding her guilty, Afiqah said Ong's defence was a bare denial.
Ong had also claimed she wanted to leave the police station with her son because he was unwell, but the magistrate ruled that this was baseless.
"The CCTV recording showed that the accused's son could walk and stand normally without showing any sign of being in an emergency or experiencing pain.
"No emergency call was made by the accused or her son during the incident. If he was in a critical condition, an emergency call would have been made and an ambulance would subsequently come," Afiqah said.
She also said the seven-day sentence imposed on Ong was fair.
"The sentence for such an offence must reflect that the public interest is safeguarded," she said.
