Circle CEO Jeremy Allaire has a message for anyone nervous about the midterms: the GENIUS Act isn’t going anywhere.
Allaire says Democrats will not reverse the stablecoin law even if they win control of the House. His reasoning is simple. Plenty of Democrats voted for it in the first place.
The case for staying power
Allaire made the argument in a CNBC interview on October 21, 2026. That same day, the Office of the Comptroller of the Currency (OCC) released its final rules for implementing the law.
The GENIUS Act was signed into law on July 18, 2025. It cleared the Senate 68-30 and the House 308-122.
Those margins included 102 House Democrats and 18 Senate Democrats voting yes.
Allaire’s point is that wide support insulates the law from future political swings. Repealing a bill requires lawmakers to undo their own votes. Many of the Democrats who would hold the gavel in a flipped House are the same ones who voted for this law.
He also framed the law as more than a crypto win. Allaire described it as important for the strength of the US dollar, since it locks in a formal role for digital dollars.
What the OCC rules actually require
The OCC’s final rules put concrete standards on payment stablecoin issuers. They cover reserve requirements, faster redemption processes, custody rules and capital ratios.
The headline requirement is full 1:1 reserves. Every stablecoin in circulation must be backed by an equivalent asset held in reserve.
The law also bars non-permitted issuers from issuing payment stablecoins in the US. Only approved players get to operate in that lane.
The OCC rules take effect on January 18, 2027. That date mirrors the timeline for the GENIUS Act becoming fully effective.
Allaire said the framework gives USDC long-term policy certainty. He suggested that puts Circle’s stablecoin in a better position than other corners of the digital asset market that may face more regulatory uncertainty.
Why Circle has a lot riding on this
Circle is the issuer of USDC, one of the largest dollar-backed stablecoins. Its circulation reached $73.3 billion in Q2 2026, up 19% year-on-year.
A law that could be torn up after one election would be a shaky foundation. A law with bipartisan fingerprints all over it is a sturdier one. That’s the core of Allaire’s pitch.
Of course, a CEO defending the rulebook that favors his business is not exactly a plot twist. Allaire has an obvious interest in the law surviving. Still, the vote tallies he points to are a matter of public record, not marketing copy.
Background: how stablecoins got here
Stablecoins are crypto tokens designed to hold a steady value, usually pegged to the US dollar. They are widely used for trading, payments and moving money across borders.
For years, issuers operated without a dedicated federal framework. The GENIUS Act changed that by setting out who can issue payment stablecoins and under what conditions.
The OCC’s final rules translate the law’s broad strokes into operational requirements. With the rules now released, the remaining gap is the January 18, 2027 effective date. Between now and then, issuers have to prepare to meet the reserve, redemption, custody and capital standards.
What this means
For stablecoin issuers, the near-term story is compliance. The 1:1 reserve requirement and expedited redemption rules set a clear bar, and issuers that can’t clear it won’t be allowed to operate in the US market for payment stablecoins.
The political risk is the piece Allaire is trying to defuse. If control of the House changes, lawmakers could still push for amendments or tougher oversight, even without a full repeal. Allaire’s argument covers reversal, not every possible tweak.
Allaire suggested that other parts of the digital asset market may face more uncertainty than stablecoins. Payment stablecoins now have a law and final rules, while other sectors are still waiting on comparable clarity.
The key dates to track are straightforward. January 18, 2027 marks when both the OCC rules and the GENIUS Act reach full effect. The outcome of the House race will test whether the 102 Democratic yes votes translate into the durability Allaire is counting on.
