\KUALA LUMPUR: Bersatu has warned that today's emergency Perikatan Nasional (PN) Supreme Council meeting could carry serious legal implications as the coalition's registration has been cancelled.
Bersatu secretary-general, Datuk Seri Mohamed Azmin Ali, said all parties should preserve the status quo of the Registrar of Societies' decision until all court proceedings had been exhausted.
He questioned why Datuk Seri Takiyuddin Hassan had issued the invitation to the meeting on Oct 23 when a notice of appeal had been filed at the Court of Appeal on the same day on behalf of the Registrar of Societies and the Home Minister.
"If Pas and its allies still proceed with the 'Perikatan Nasional Supreme Council' meeting in the situation explained above, Bersatu is concerned that the proceedings of the meeting and the decisions made at it carry serious legal implications," he said in a statement today.
He said that although PN obtained a stay from the High Court on Oct 22, the court had noted that the deregistration had already taken effect.
"The court also accepted that a stay order cannot be automatically deemed to restore a registration that has been cancelled," he said.
He said that under the Societies Act 1966, a deregistered society becomes unlawful, while any office-bearer or person managing it commits an offence punishable by up to five years in jail.
"Bersatu will bring this matter to be discussed with lawyers to ensure that the implementation of the law in accordance with the PN Constitution and the Societies Act 1966 is carried out lawfully and in an orderly manner," he said.
He added that the meeting's organisers must first state their position on the Bersatu Supreme Leadership Council quorum issue and Bersatu's membership in PN. He said these issues had been used to deny the party's right to attend and vote at the coalition's Supreme Council meeting on July 16.
"They also often dispute Bersatu's membership when Bersatu is a legitimate member party of PN, as affirmed by the Registrar of Societies in a letter dated Aug 12, 2026," he said.
On Oct 13, the High Court granted PN leave to initiate a judicial review against two actions by the Registrar of Societies: a show-cause notice under Section 13(2) of the Societies Act 1966 and an order under Section 13(2)(A) suspending the coalition's activities.
The Registrar of Societies confirmed on Oct 20 that it had cancelled PN's registration, saying the coalition's explanation had failed to address the grounds for cancellation outlined in an earlier notice.
