ISLAMABAD: The Islamabad High Court (IHC) on Saturday granted appeals of the Sui Northern Gas company in gas arrears recovery case.
The high court said in the written decision that in gas arrears recovery cases the time duration has not been applicable.
Justice Raja Inaam Amin Minhas of the IHC issued written verdict of the case.
The bench granted three appeals of the Sui Northern Gas and declared the gas utility court’s decision as void.
The court sent the cases back to the gas utility court for rehearing.
The gas utility court had dismissed the Sui Northern cases owing to being time barred.
“Clause-20 of the gas theft prevention law set aside the duration condition,” court said in its decision. “Under the specific law, the duration of general law could not be applicable over recovery of gas arrears,” court observed.
The high court also directed to the gas utility court to decide the cases according to the law.
The Sui Northern Gas has claimed over 6.29 billion outstanding amount in arrears against three gas consumers.
The Islamabad High Court has also directed to the gas utility court for prompt decision of the cases.
