Guatemala arrests 7 police officers over the detention of two food-delivery brothers who were named as suspects in the murder of anti-corruption lawyer Juan Francisco Solórzano Foppa, the Interior Ministry said on Friday 23 October 2026. The seven, a commissioner, an inspector, a third-grade officer and four agents, were taken to the Torre de Tribunales courthouse that night to give a first statement to a judge.
For US readers the case matters because the US Embassy in Guatemala condemned the killing on the day it happened and called for a complete and transparent investigation. A source told Prensa Libre that FBI agents are helping prosecutors, although the Public Ministry has said only that it has technical support from international allies.
The arrests do not solve the murder, because nobody has been detained for the shooting that killed Solórzano Foppa and a second man, Gustavo Adolfo Aguilar Gamarro, at a Guatemala City sports complex on Saturday 17 October. They deal with the first arrest in the case, which police presented as the capture of the suspects and which a judge undid within a day.
In plain English
- —Solórzano Foppa A 43-year-old lawyer who worked as a state prosecutor and later led Guatemala’s tax agency, SAT.
- —PNC The National Civil Police, Guatemala’s main police force, which answers to the Interior Ministry.
- —Comisaría 13 The police unit whose officers arrested the two brothers on the day of the killing.
- —Torre de Tribunales The courthouse tower in Guatemala City where suspects are brought before a judge.
- —Falta de mérito A judge’s ruling that the evidence is too thin to continue a case, so the suspect goes free for now.
- —Public Ministry Guatemala’s prosecutor’s office, known as the MP.
How the First Arrest Fell Apart
Gunmen shot Solórzano Foppa at the Campo Marte sports complex in zone 5 of Guatemala City on the morning of Saturday 17 October, in an attack that also killed Aguilar Gamarro. Police said they caught two brothers, Rigoberto and Daniel Zaqueo Choc Toz, in zone 16 soon afterwards and showed a carbine as evidence.
The brothers, who deliver food by app, denied any role, and a judge freed both for lack of merit on Sunday 18 October. Prensa Libre reported that police say the carbine is registered to a private individual and has no theft report, and Plaza Pública reported that its owner is under investigation.
What Police Leaders Told Lawmakers
On Wednesday 21 October the deputy director of police operations, Esvin Jacinto, told lawmakers that the arresting officers took the brothers to a police station instead of straight to the Torre de Tribunales, as the rules require. He said patrol cars were swapped and routes changed without telling senior commanders, which he called a break in the chain of command.
Plaza Pública counted nine irregularities in about three hours and reported that, at the station, the captors made the brothers kneel and pose for photos in front of the weapon. On Thursday 22 October police director David Custodio Boteo said several officers and the station chief had been removed from their duties, and prosecutors inspected patrol car GUA 13190 the same day.
What the Seven Officers Face
The Interior Ministry said the officers were put before the courts for alleged irregularities in the detention, on arrest warrants from the Third Criminal Court of First Instance in Guatemala City. Publinews described the accusation as abuse of authority and the alleged planting of a firearm.
La Hora reported that the weapon was said to have been planted by the officers themselves and did not match the one used in the attack, a claim the ministry has not made and that no court has tested. The brothers also say the carbine was planted, and the officers have not been heard by a judge.
The ministry withheld the officers’ names, citing the presumption of innocence, although police published the brothers’ names, ages and photos on the day of their arrest. One officer told reporters at the courthouse that the case reflected political exploitation and that organised crime was to blame.
At the first hearing a judge hears each officer and then decides whether there is enough evidence to continue the case. No ruling had been published in the outlets reviewed by Saturday morning.
Why Guatemala Arrests 7 Police Matters Now
Solórzano Foppa was known for criminal analysis at the Public Ministry, including expert work in the La Línea corruption case that forced President Otto Pérez Molina to resign in 2015, and in 2022 he took on the defence of jailed journalist José Rubén Zamora. Prensa Libre also recalled that he was convicted in three cases during the term of then attorney general Consuelo Porras, and that in one of them, in June 2023, he accepted the charges.
President Arévalo said at the funeral on Monday 19 October that he demands justice, ruled out a state of emergency and warned against political use of the killing. The Interior Ministry announced on Tuesday 20 October a deep review of the police, and Interior Minister Marco Antonio Villeda has said officers could be dismissed if illegality is proven.
The US Embassy called Solórzano Foppa a firm defender of the fight against corruption and organised crime. The Organization of American States also demanded that the crime be clarified.

What Is Not Known
Nobody has been named or detained for the shooting, and the sources reviewed do not say who fired the shots, who ordered them or why. The Public Ministry has not confirmed that the FBI is involved, and the name comes from one source quoted by Prensa Libre.
The officers’ names have not been released, and the judge’s decision after their first statements was not public when this article was written. Whether the carbine was planted is an allegation that no court has decided.
The sources also do not agree on the number of spent cartridge cases at the scene, with reports ranging from more than 50 to at least 57. The brothers have threatened legal action against the state, and it is not known whether they will file a claim.
