British father battles UK visa refusal that threatens his baby’s first Christmas in Lancashire. His Burmese fiancée is barred from visiting despite their Koh Tao business and home. Now £3,000 in costs loom as ailing great-grandfather awaits the baby.
A British father faces a £3,000 visa battle after the UK Home Office barred his Burmese fiancée from a Christmas family visit. Matthew Cross, 31, wants their British baby son to meet his seriously ill 74-year-old great-grandfather in Lancashire. However, officials doubt whether the mother would return to Thailand, despite the couple’s Koh Tao restaurant, new home and land purchase. Her lack of bank records has further complicated the case. Meanwhile, the family has already spent £400 travelling to Phuket for visa procedures. With no ordinary right of appeal, Cross must submit another application despite warnings of a further refusal. Christmas plans now hang on a fresh Home Office decision.
A British father faces a £3,000 battle with the UK Home Office after officials refused his Burmese fiancée a visitor visa. Matthew Cross, 31, wants to take his partner and their British baby son from Koh Tao to Lancashire for Christmas.
However, immigration officials doubt whether the child’s mother would return to Thailand. The decision has threatened a reunion with the baby’s seriously ill 74-year-old great-grandfather. Now, the couple are preparing another application despite warnings that a second refusal is likely unless their circumstances change.
Cross, a mechanical engineer from Burnley, Lancashire, has established a business and family life on Thailand’s Koh Tao island. He opened a steakhouse restaurant approximately 15 months ago on the popular tourist island in Surat Thani province. Subsequently, he met his Burmese partner, Khin Thant Zin, 31, who is known as Jue Jue. The couple are now engaged and have a young son, William Cross, born in Thailand on April 30, 2026.
British baby can enter UK but Burmese mother faces visa refusal threatening Christmas family reunion
William is a British citizen through his father. Consequently, he can travel to the United Kingdom without obtaining a visitor visa. His mother, however, must obtain permission from the Home Office before entering Britain.
That requirement has now thrown the family’s Christmas arrangements into disarray. Despite their established life in Thailand, immigration officials remain unconvinced that Khin Thant Zin would return after the holiday.
The couple planned to travel to Burnley with William for a family Christmas gathering. Crucially, the visit would allow the baby to meet his great-grandfather, George Kerr, 74, for the first time. Kerr lives in Clayton-le-Moors, Lancashire, and suffers from several health problems. As a result, he cannot undertake the long journey to Thailand. Cross’s parents have already visited Koh Tao and met their grandson, but Kerr has not.
The family therefore arranged the Christmas gathering to bring four generations together. Instead, the Home Office refused Khin Thant Zin’s visitor visa application. The decision has left Cross preparing another costly submission while the family waits in Lancashire. The case was reported by The Guardian on Saturday, October 17, and subsequently attracted coverage in Thailand.
Seriously ill great-grandfather unable to travel as British father fights for baby’s Christmas visit
Cross has spoken publicly about his grandfather’s health and the importance of the planned meeting. “My grandfather suffers from ill health and sadly he is unable to travel,” he told The Guardian. He also described their close relationship and his determination to arrange the visit.
“He and I have been extremely close all my life and I’m desperate for him to meet his [great] grandchild.”
The family’s difficulties arise from the different immigration status of its three members. Cross is British, while William also holds British citizenship. Both can enter Britain without visitor visas. In contrast, Khin Thant Zin must independently satisfy the immigration requirements applying to her Burmese nationality. Her relationship with Cross and their British child does not automatically qualify her for entry.
Khin Thant Zin previously fled persecution in Burma before settling in Thailand. She subsequently established a relationship with Cross and joined him in his restaurant business. Her responsibilities include social media management and human resources. Furthermore, the couple recently signed a lease on a new home on Koh Tao. They have also purchased land on the island for future development.
Koh Tao restaurant, new home and land purchase fail to convince UK officials family will return home
These commitments form a central part of Cross’s argument against the refusal. He maintains that the couple have established their future in Thailand rather than Britain.
Their restaurant operates on Koh Tao, while their accommodation and investment plans are also based there. Additionally, Khin Thant Zin has close relatives living on the island. Nevertheless, immigration officials rejected the evidence submitted with her application.
The Home Office was not satisfied that she qualified as a genuine visitor. Specifically, officials questioned whether she would leave Britain after the proposed Christmas holiday. The refusal cited insufficient evidence of significant family ties to Thailand. It also raised concerns about documentation supporting her income. Those findings have become the principal obstacles to the family’s planned journey.
Cross disputes the assessment of his fiancée’s family connections. Her brother and sister both live on Koh Tao, where the couple operate their business. Separately, her mother intends to relocate to the island after her youngest daughter completes school in Burma. Cross considers these circumstances further evidence of the family’s continuing commitments to Thailand.
Burmese fiancée’s missing bank records deepen Home Office doubts despite employment and family ties
Yet the application has also been complicated by Khin Thant Zin’s financial records. According to Cross, his fiancée has never maintained a bank account. Although she works at the restaurant, she cannot produce conventional statements documenting her earnings. That absence has made it difficult to satisfy the Home Office’s requirements for financial evidence.
“Jue Jue has never had a bank account,” Cross explained.
The lack of banking records has proved significant because British visitor visa rules require evidence of an applicant’s circumstances.
Officials examine income, employment, family connections and other commitments when assessing whether someone intends to leave Britain. Financial sponsorship from relatives can support an application. However, it does not automatically establish that the applicant will return to their country of residence.
Cross has pointed to the couple’s restaurant, home lease and land purchase as evidence of their intentions. In addition, he has highlighted Khin Thant Zin’s employment and the presence of her siblings on Koh Tao. The couple say they intend to return after spending Christmas with relatives. Despite those assurances, the Home Office concluded that the evidence was insufficient.
British relatives provide sponsorship papers before costly Koh Tao to Phuket biometric appointment
The refusal followed an application process involving extensive documentation from Cross and his family in Britain. According to Cross, officials required identification photographs from his grandfather, parents and himself.
Each family member also provided a written statement confirming willingness to support Khin Thant Zin financially. Moreover, his parents issued a formal invitation confirming that she could stay at their home during the visit.
The family therefore submitted evidence of financial support and accommodation in Lancashire. These arrangements were intended to establish how Khin Thant Zin would be supported during her stay. However, the Home Office remained concerned about her circumstances in Thailand. The British sponsorship documents did not overcome doubts about her intention to leave Britain.
Another major expense arose from the requirement to attend a biometric appointment. The couple had to travel from Koh Tao to Phuket to complete the procedure. Their journey involved ferries and buses and extended over two nights and three days. According to Cross, the trip alone cost approximately £400. That expenditure came before officials had decided whether to grant the visa.
“We had to travel to Phuket, a journey of two nights and three days from Koh Tao on a ferry and buses, which cost us £400, to complete biometric screening required for the visitor visa application.”
Family faces £3,000 visa bill and no ordinary appeal after Home Office rejects Christmas travel plans
Despite completing the journey and submitting their documents, the couple received a refusal. The decision has left them considering another application and further expenditure. They may also have to repeat travel arrangements connected with the process. Meanwhile, Cross says the family faces additional costs associated with providing evidence of return flights.
The financial consequences could be substantial. Cross estimates that the entire process may eventually cost approximately £3,000 if they submit another application. That figure covers the wider expenses involved, rather than simply the Home Office visa charge. Yet another payment would provide no guarantee that officials will reach a different decision.
“By the time we send our next application, the whole thing will have cost us £3,000 with no guarantee of it being accepted,” he said.
The couple face another obstacle because ordinary appeals against British visitor visa refusals are generally unavailable. Instead, they must prepare a fresh application addressing the concerns identified by immigration officials.
The original refusal letter reportedly warned that another application would probably fail unless their circumstances changed. Consequently, the family must find additional evidence capable of overcoming the earlier objections.
Fresh application must overcome refusal warning as UK visitor rules demand proof of return to Thailand
That warning has complicated Cross’s efforts to secure permission before Christmas. He maintains that the couple already have substantial reasons to return to Thailand.
Their restaurant, new home and land purchase are all connected to Koh Tao. Furthermore, Khin Thant Zin’s employment and family relationships are based on the island. Nonetheless, officials have not accepted the documentation presented so far.
The next application must therefore address the Home Office’s concerns about income and family ties. Cross and his fiancée must demonstrate that their planned visit is temporary. They must also provide evidence supporting their intention to return to Thailand afterwards. However, the lack of conventional banking records remains an unresolved difficulty.
Under the United Kingdom’s Standard Visitor rules, applicants must satisfy several conditions before receiving permission to enter. They must establish that they intend to leave Britain at the end of their visit. Additionally, they must demonstrate that sufficient funds are available to cover their expenses. Support from relatives or other third parties is permitted when the relevant requirements are met.
Nevertheless, financial sponsorship alone does not establish that an applicant qualifies as a genuine visitor. Immigration officials also consider employment, family relationships and economic commitments outside Britain. The applicant’s personal circumstances therefore remain important even when accommodation and expenses are covered. In this case, Cross’s relatives offered financial assistance and a place to stay.
British baby’s citizenship offers no visa exemption for mother as ordinary appeal rights remain closed
The Home Office’s concerns instead centred on Khin Thant Zin’s position in Thailand. Officials questioned her income evidence and whether she had sufficient family ties there.
Cross has challenged that assessment by referring to the couple’s business and investment commitments. He has also identified her brother and sister as residents of Koh Tao.
Notably, William’s British citizenship does not remove the immigration requirements applying to his mother. The baby can travel to Britain through his nationality, as can his father. Khin Thant Zin, however, must obtain a visitor visa independently. The family therefore faces different entry requirements despite intending to make the same Christmas journey together.
A House of Commons Library briefing published in June 2026 examined the rules governing visitor visas. It explained that insufficient evidence of employment, finances or family ties abroad can result in refusal. The briefing also confirmed that ordinary appeals against visitor visa refusals were abolished in 2013. Consequently, unsuccessful applicants generally cannot challenge the merits of a decision through a conventional immigration appeal.
Instead, applicants can submit fresh applications supported by additional evidence. Limited legal challenges remain possible in certain circumstances, including cases involving human rights considerations. Judicial review may also be available where the lawfulness of a decision is disputed. However, that process differs from an ordinary appeal and can involve considerable expense.
MP intervention and judicial review offer limited options while couple seek stronger financial evidence
On another front, a British MP may raise an immigration case with the Home Office. Parliamentary representatives can also request exceptional ministerial consideration. Such intervention, however, does not compel officials to approve a visa. The decision must still be considered under the applicable immigration rules.
In May 2026, the British government confirmed that it had no plans to restore general visitor visa appeal rights. Instead, unsuccessful applicants were advised to submit further applications addressing the original reasons for refusal. That procedure now applies to Cross and his fiancée. Their next submission must contain evidence capable of answering the Home Office’s stated concerns.
The couple’s difficulty is particularly acute because Khin Thant Zin has never maintained a bank account. Cross says she works in the family restaurant, handling social media and human resources. Nevertheless, conventional banking documents are unavailable to support her employment and income claims. The couple must therefore rely on other evidence when preparing their next application.
Their existing commitments include the restaurant Cross opened approximately 15 months ago. They have also signed a lease on a new home and purchased land for future development. In parallel, Khin Thant Zin’s brother and sister live on Koh Tao. Her mother also plans to move there after her youngest daughter finishes school in Burma.
Home Office declines to discuss refusal as British father prepares fresh case for Christmas reunion
These circumstances form the basis of Cross’s argument that the family intends to remain in Thailand. Yet the Home Office has not accepted the evidence already submitted. The couple must now decide how to strengthen their case without changing their stated travel plans. They continue to seek permission for a temporary Christmas visit rather than permanent settlement.
The Home Office has declined to discuss the individual circumstances surrounding the refusal. However, a spokesperson issued a statement explaining the department’s approach to visitor visa applications.
“We do not routinely comment on individual cases. All visa applications are carefully considered on their individual merits, in line with the immigration rules and based on the information and evidence provided by the applicant.”
The statement provided no indication that officials would reconsider the refusal without another application. Nor did it offer any assurance that additional evidence would secure approval. There was also no confirmation that the family would receive expedited consideration because of Kerr’s health. As matters stand, the couple must pursue the application process again.
British infant’s journey to Lancashire depends on mother’s visa after costly paperwork fails to convince
Cross’s immediate objective remains a Christmas journey to Lancashire with his fiancée and son. His parents have already offered accommodation and financial support for Khin Thant Zin. Other relatives have also supplied sponsorship documents. Despite these arrangements, the original application failed because officials questioned whether she would return to Thailand.
The refusal has also complicated travel arrangements for William. Born on April 30, the British baby will be nearly eight months old by Christmas. He can enter Britain without a visitor visa, but his mother cannot accompany him without permission. Consequently, the family cannot proceed with its original plan to travel together unless another application succeeds.
Cross has not sought permanent residence in Britain for his fiancée through the visitor application. The stated purpose is to spend Christmas with relatives before returning to Koh Tao. Their home and restaurant are based in Thailand, where they also have plans for future development. However, the Home Office remains unconvinced that Khin Thant Zin would leave Britain after the holiday.
The couple now face another round of paperwork and potentially another costly journey. Their previous trip to Phuket cost approximately £400, according to Cross. Moreover, the application required sponsorship statements, identification documents and an invitation from his parents. All that preparation failed to secure approval.
Christmas deadline looms as £3,000 costs and great-grandfather’s ill health complicate family reunion
The prospect of total expenses reaching £3,000 has added another complication. Cross says the figure could be reached by the time they submit their next application. Nevertheless, there is no guarantee that the Home Office will accept the new evidence. The refusal letter’s warning about another possible rejection remains a further obstacle.
Time is also becoming an issue. The family wants to travel for Christmas, while Kerr remains unable to make the journey to Thailand. Cross’s parents have already visited Koh Tao and met William. In contrast, the baby’s great-grandfather has not had that opportunity because of his health problems.
The planned gathering in Burnley was intended to bring four generations together. Kerr, 74, lives in Clayton-le-Moors and suffers from several medical problems. As a result, the family arranged for the baby to travel to Britain rather than expecting Kerr to visit Thailand. The Home Office refusal has now placed that arrangement in doubt.
Relatives in Lancashire have already purchased warm baby clothes for William’s anticipated Christmas visit. Such clothing is unnecessary on Koh Tao, where temperatures rarely fall below 25°C. However, the family had expected the baby to need winter clothing during his first trip to Britain. Those preparations were made before the visa application was rejected.
Koh Tao couple prepare new visa evidence as Home Office offers no assurance of Christmas approval
Meanwhile, Cross and Khin Thant Zin remain on Koh Tao, preparing further evidence for the Home Office. Their restaurant continues to operate on the island, where they have also committed to a new home. Separately, their land purchase forms part of their future development plans. These commitments have not yet persuaded British officials to approve the proposed visit.
The next application will again place Khin Thant Zin’s finances and family circumstances under examination. Officials must decide whether the new evidence establishes that she intends to leave Britain after Christmas.
Until then, the couple cannot confirm their intended family journey. The Home Office has offered no assurance that another application will succeed.

Cross must therefore prepare another submission while his relatives wait in Lancashire. His grandfather remains unable to travel, and the family has no confirmed date for William’s arrival. The original Christmas arrangements depend on securing permission for Khin Thant Zin to accompany her British fiancé and son.
The couple’s next move is a fresh visitor visa application, supported by further evidence of their commitments in Thailand. However, the Home Office has already warned that another refusal is likely unless their circumstances change. With Christmas approaching, no approval has been confirmed, and the family’s planned reunion remains dependent on another immigration decision.
