Sri Lanka’s efforts to attract foreign direct investment (FDI) face a fundamental credibility test, with US Ambassador Eric Meyer identifying policy and regulatory unpredictability as the single greatest deterrent to foreign capital, despite the country’s recent economic progress. His warning exposes a critical weakness in the island’s investment strategy: economic recovery alone cannot persuade international businesses to commit billions of rupees or dollars if government decisions, regulations and project approvals remain uncertain.
Addressing the 10th Annual General Meeting of the Sri Lanka–USA Business Council (SLUSABC) yesterday, Meyer stressed that sudden policy changes and project reversals made it difficult for foreign investors to undertake long-term ventures. He argued that predictable regulations, transparent governance, intellectual property (IP) protection and fair competition were essential foundations for sustainable economic growth.
The Ambassador’s remarks raise important questions about Sri Lanka’s ability to translate improving macroeconomic conditions into productive investment, employment generation, export expansion and technology transfers. Investors do not assess a destination solely on its labour costs, geographic location or access to regional markets. They also examine whether government policies will remain consistent throughout the lifespan of a project.
For a company planning a manufacturing facility, energy project, technology centre or logistics operation, a sudden change in tax treatment, licensing requirements, procurement conditions or regulatory interpretation can substantially alter projected returns. Uncertainty can increase financing costs, delay implementation and discourage investment committees from approving projects altogether.
Meyer did not identify specific Sri Lankan projects or policy reversals in his address. Nevertheless, his assessment places the responsibility on policymakers to demonstrate that investment commitments will be supported by stable, transparent and consistently administered rules.
Intellectual property protection represents another important consideration, particularly as Sri Lanka seeks to attract American businesses operating in information technology, pharmaceuticals, engineering, research and advanced manufacturing. Companies bringing proprietary software, production processes, designs and technical knowledge need confidence that their commercial assets will receive effective legal protection.
Weak enforcement or lengthy disputes could discourage technology-intensive investors, limiting Sri Lanka’s ability to move beyond low-value activities towards higher-productivity industries. Fair competition is equally important. Domestic and foreign companies must have confidence that market access, government contracts and regulatory decisions will not favour selected businesses at the expense of competitors.
Meyer reaffirmed Washington’s commitment to stronger commercial ties and disclosed that the US Embassy had secured funding to bring American technical expertise to support modernisation in Sri Lanka’s ports, energy and high-tech sectors. Such cooperation could help improve productivity and infrastructure, provided projects are selected transparently and implemented efficiently.
However, technical assistance and diplomatic encouragement cannot substitute for domestic institutional reform. Sri Lanka must demonstrate that investment approvals are timely, public procurement is transparent, contracts are respected and regulatory decisions are supported by clear legal principles.
The Government should therefore establish measurable indicators for approval times, regulatory changes, investment commitments and project implementation. Publishing these indicators would allow businesses and citizens to assess whether reforms are producing tangible results.
Meyer also urged business leaders to press for reform, arguing that private-sector credibility could help convert discussions into policy changes.
His warning should be treated as an opportunity rather than merely a diplomatic observation. Sri Lanka’s recovery will remain incomplete if investors continue to regard uncertainty as a greater risk than opportunity. Restoring confidence requires consistent policies, credible institutions and accountability for decisions that affect long-term investment.
