Puerto Rico Film Industry Incentives and Tyler Perry

PUERTO RICO · FILM INDUSTRY

Puerto Rico film industry incentives are in focus after local reports that US producer Tyler Perry bought a US$30 million home on the island and plans to film there. Perry told TODAY on 14 September 2026 that he would move to the island at the start of 2027 and pull back from work, while the reports say his Atlanta studios will keep operating.

Metro Puerto Rico published the story on Saturday 17 October 2026, and El Nuevo Día carried an English version on 18 October. Both attribute the purchase and the plans to TMZ, and we have not confirmed them in property records.

This article describes no Perry project, because none has been announced, and instead sets out the rules that any such project would meet. It relies on the circular letter that the island’s Department of Economic Development and Commerce (DDEC) issued on Tuesday 7 April 2026.

Puerto Rico Film Industry Incentives in 2026

The rules sit in the island’s Incentives Code, Act 60 of 2019, and the Puerto Rico Film Commission inside the DDEC runs the film side. The April circular restated what a film project with a tax-exemption decree can receive.

Income from the project is taxed at a flat 4%, and dividends paid out of it are fully exempt. The decree also gives a 75% exemption from property taxes and a full exemption from municipal licence tax.

Goods bought for use only in film work are exempt from excise and sales and use taxes. Payments to non-residents carry a preferential 20% withholding rate in place of the standard rates.

The tax credit is the headline benefit, at up to 40% of production spending in Puerto Rico. It is up to 20% for spending that consists of payments to qualified non-resident individuals.

A further credit of up to 15% applies to feature films, episodic series and documentaries led by a domestic producer, with key roles such as director, cinematographer and editor held by island-based persons. Whether a company owned by a mainland producer counts as domestic depends on definitions in the Code that this article does not test.

The Cap That Limits the Credits

All film credits compete under an annual limit of US$38 million per fiscal year, the circular says. Act 5 of 2023 raised the limit to US$100 million, but the Fiscal Oversight Board had not authorised the increase when the circular was issued.

On 31 December 2025 the commission held about 67 pending decree applications, filed between 2020 and 2025, that asked for US$170.4 million in credits. That is more than four times what one year’s limit allows.

Ernesto Zayas García, who directed the DDEC business incentives office at the time, told El Vocero in April that the commission had approved more than 17 decrees for projects ready to film. He said that left it close to the cap for the fiscal year then running, and that the backlog had grown like a snowball.

From the fiscal year that began on 1 July 2026, applications that were not approved are archived, which the circular treats as a tacit denial. Projects without financing are urged to withdraw and reapply when they can start filming within 120 days of a decree.

The circular reserves film credits for feature films, documentaries and episodic series. Talk, news, game, comedy, children’s and variety programmes face separate ceilings of US$300,000 a year in total and US$100,000 per programme.

The commission can reclassify a project according to its real characteristics, whatever category the applicant chose. How it would classify any Perry production is therefore a question only the commission can answer.

Options Beyond the Tax Credit

A producer with at least three earlier film projects can apply for a 15-year Film Productions Master Grant that covers successive feature films. Each later film is added by amendment and draws on the credit balance of the year it joins.

The producer must show financing in hand and commit to hire island-based actors and technical staff. The master grant covers feature films of at least 60 minutes, so a series would need its own decree.

A company that operates a film or post-production studio can obtain a separate 15-year decree with a 4% income tax rate and a 75% property tax exemption. The film tax credits do not extend to that decree, because the circular reserves them for film projects.

Studio and creative businesses in San Juan, Guaynabo, Bayamón, Carolina, Caguas, Fajardo, Ponce, Mayagüez and Arecibo are automatically treated as eligible for a decree. The reports on Perry mention a production office, not a studio.

Cash support is small beside the credits, with up to US$50,000 for projects that received no film credits and up to US$150,000 for feature co-productions with other jurisdictions. Metro reported in August 2025 that the commission’s sponsorship budget for 2025-26 was US$450,000.

Conditions in the Local Industry

Of US$74 million in federal pandemic-recovery money set aside for film, US$68 million supported 29 films, according to the DDEC figures Metro published in August 2025. Producers told Metro that local titles in cinemas had multiplied, though distribution beyond the island remained a weak point.

Researcher Javier Hernández Acosta of the Centro de Economía Creativa warned that large foreign productions can absorb funds that would pay for many local films. He said one US$20 million Hollywood film would use what 20 local films of US$1 million could receive.

The film workers’ union IATSE Local 494 said in February 2026 that more than 1,500 families tied to the sector had no work. It spoke after news that the Residente and Bad Bunny film Porto Rico might not shoot on the island.

A Fortaleza official told radio that the DDEC was still evaluating a decree request for that film. Acento, a Dominican outlet, reported in April that the main shoot was moving to the Dominican Republic and pointed to the cap.

What It Means for You

For US producers and crews, Puerto Rico offers generous terms on paper, but the US$38 million cap means no project can count on a credit. A film needs a decree before it films and must begin photography within 120 days of it.

For Puerto Rican film workers, the main question is whether any Perry work would hire on the island. The circular ties the larger credit tiers to island-based spending and key crew, and it requires proof of payroll through island tax filings.

What Is Not Known

No project, budget, start date or filming location has been announced, and the coverage says only that Perry plans a production office and filming. It is not known whether Perry or any of his companies would apply for a decree or credits.

The purchase itself comes from TMZ through Puerto Rican outlets, and we have seen neither a property record nor a statement from Perry’s representatives. It is also unknown how much of the US$38 million for the fiscal year that began on 1 July 2026 is still available.

The coverage does not say whether a film, a series or a studio would come first, so the category and credit tier cannot be named. The DDEC had not commented in the coverage we reviewed.

Frequently Asked Questions

What have Puerto Rican outlets said about Tyler Perry?

They say he bought a US$30 million home on the island and plans a production office and filming. No project or timing has been given.

What tax credit does Puerto Rico offer film productions?

It offers up to 40% of local production spending, up to 20% for payments to qualified non-residents and up to 15% extra for qualifying projects. All credits share a cap of US$38 million a year.

Is a film tax credit guaranteed in Puerto Rico?

No, because a project needs a decree and applications compete under the annual cap. At the end of 2025 about 67 applications asked for US$170.4 million.

How soon must a decree holder start filming?

Principal photography must begin within 120 days of the decree. Projects produced before the decree is approved are not eligible.

What does this mean for US readers?

It shows what a US producer could weigh when choosing the island, and how limited the credit pool is. Nothing yet confirms that any Perry project will use it.
