Citizens for Justice and Peace (CJP) members Saurav Das and Ashutosh Ranka have approached theDelhi High Court challenging their judicial custody, as the cases registered against them over separate protest related incidents have been transferred to the Delhi Police Crime Branch for further investigation.
According to reports, the two moved the High Court on October 20, a day before a special executive magistrate was scheduled to consider whether their custody should be extended. Das and Ranka were detained on October 13 after allegedly climbing a gate to enter Jantar Mantar, which had been denotified as an authorised protest site. They were protesting against the Special Intensive Revision (SIR) of electoral rolls.
They had spent seven days in custody, including an initial five-day period followed by a two-day extension that was due to expire on Wednesday. They sought an urgent hearing from the High Court. However, the court was closed for Dussehra, and the case was not listed for a hearing that week as of late Tuesday.
Meanwhile, the Delhi Police transferred the cases registered against the two activists to the Crime Branch. The cases stem from protests held at Jantar Mantar and Connaught Place on October 13, reportedly without permission.
The transfer means the Crime Branch will investigate the allegations linked to both incidents. The legal challenge against their custody comes as the authorities are due to decide whether further detention is necessary.
If the executive magistrate orders their release, the petition challenging their custody could become redundant. The developments have brought renewed attention to the legal proceedings against the CJP members and the handling of protests related to the voter-roll revision.
