Caroline Pham says the Commodity Futures Trading Commission's jurisdiction is broader than most realize, with a few historical carve-outs.
Caroline Pham, who served as Acting Chair of the Commodity Futures Trading Commission, says the agency's regulatory authority is far broader than many assume. According to reporting from The Block and CryptoBriefing, Pham said the CFTC can oversee nearly all commodities, with two notable exceptions: onions and box office receipts.
The remark, while pointed with humor, highlights a serious feature of U.S. commodities law. Congress has at times carved out specific markets from CFTC oversight, usually after political or economic controversy. Those carve-outs remain on the books even as the agency's jurisdiction has otherwise expanded over decades to cover everything from agricultural goods to energy products and financial derivatives.
Pham's comments arrive at a moment when the CFTC's reach into digital assets is under intense scrutiny. Lawmakers, regulators and industry participants have spent years debating whether cryptocurrencies should fall primarily under CFTC or Securities and Exchange Commission oversight. The distinction matters because the two agencies operate under different statutory frameworks, enforcement powers and registration requirements.
As Acting Chair, Pham was a vocal advocate for clearer digital asset rules. She has previously argued that similar financial risks should receive similar regulatory treatment, regardless of whether an asset is labeled a security or a commodity. Her latest comments reinforce that view, framing the CFTC's statutory mandate as expansive by design, rather than narrowly tailored to traditional futures markets.
The commodities classification question carries real consequences for crypto firms. If a token is deemed a commodity, it falls under CFTC jurisdiction for derivatives trading and, under some legislative proposals, potentially for spot market oversight as well. If classified as a security, issuers and exchanges face SEC registration and disclosure requirements instead.
Congress has considered multiple bills aimed at resolving this jurisdictional overlap, often referred to broadly as market structure legislation. Pham's framing of the CFTC's authority as nearly all-encompassing, aside from a handful of historical exceptions, may be read as an argument for expanding the agency's role in digital asset oversight rather than ceding ground to the SEC.
Market Impact
Pham's comments do not change existing law, but they add to the ongoing policy conversation shaping how digital assets could eventually be regulated. Crypto firms watching the market structure debate may view her remarks as support for a CFTC-centric regulatory path, which many in the industry have favored over SEC oversight due to differing registration and disclosure burdens.
Any eventual shift in jurisdiction would affect how exchanges, custodians and token issuers structure compliance programs. For now, the comments function as commentary on the scope of existing commodities law rather than a signal of imminent regulatory change.
Pham's remarks serve as a reminder that commodities law, while broad, still carries historical quirks carved out by Congress decades ago. As digital asset legislation moves through Washington, her framing of CFTC authority is likely to resurface in debates over which agency should ultimately oversee crypto markets.
