By Breaking Belize News Staff (HP): A Belizean man who built and lived in his family home for more than three decades has won the right to stay there, after a ruling by the Caribbean Court of Justice.
On October 8, a five judge panel of the CCJ ruled in favour of Ewart Leroy Robateau in a property dispute with his brother, Allen Robateau.
The court overturned earlier decisions by Belize’s Supreme Court and Court of Appeal, which had granted Allen possession of the property.
The CCJ found that the evidence clearly showed Ewart alone developed the property, built the house with his own money and paid for its construction, improvements and upkeep for about 34 years. The court said that family arrangement was known.
Allen obtained title to the property in 2017. The CCJ held that he did so with full knowledge of his brother’s long occupation and claim, and therefore could not use that title to force him out.
Justice Barrow said the lower courts “got it plainly wrong,” and that it would be “unconscionable” to allow Allen to evict his brother.
